Chi ids, _C'i ty Manager <br /> ------------------------------------------------------------------------ <br /> SUMMARY DISCUSSION OF SUBJECT: The applicant has 1 i ghts in the wi ndown of his <br /> business ''Video Update'', located at 2510 Kenzie Terrace which flash so as to be <br /> visible from outside the store. The City has ordered them to be shut off because <br /> they are in violation of the sign ordinance, which prohibits flashing signs (de- <br /> fined as: an illuminated sign which contains flashing lights or exhibits noticeable <br /> change in lighting intensity) . Section 430:30, subd. 17, prohibits such signs . <br /> After several warnings, the applicant has complied with our request to turn the <br /> flashing lights off and now is requesting that it be defined as a ''historical <br /> identification symbol '', stating that these lights depict an historical image of a <br /> • movie theater. <br /> ALTERNATIVES : Interpret the ordinance to allow the flashing lights as an historical <br /> symbol or not to be an historical symbol under the intent of the ordinance. <br /> RECOMMENDATION: Staff feels that the intent of allowing historical symbols included <br /> such things as barber poles, mortar and pestle at drug .stores and other small , <br /> generally recognizable symbols of historically significant value . The lights in <br /> question represent a substantial stretch of that interpretation, do not resemble a <br /> theater marquis and even if in a theater configuration, would -still not be allowed to <br /> flash in my opinion.
