CITY OF ' ST. ANTHONY
• -----------------EQUES-----RT-FOR-PLANNING-COMMISSION_ACTION ___________
- --- -------- ----
Date Submitted : Type of Action Requested Agenda, Item Number
December 7, 1984 Concept Review New Bus i ness-a
Date Action Formal Action/Motion Title
Requested Informational
X Other Ordinance Interpretation -
December 11 , 1984 Video Update Signage
------------------------------------------------------------------------
TO: St. Anthony Planning Commission
FROM: David M. Chi ids, _C'i ty Manager
------------------------------------------------------------------------
SUMMARY DISCUSSION OF SUBJECT: The applicant has 1 i ghts in the wi ndown of his
business ''Video Update'', located at 2510 Kenzie Terrace which flash so as to be
visible from outside the store. The City has ordered them to be shut off because
they are in violation of the sign ordinance, which prohibits flashing signs (de-
fined as: an illuminated sign which contains flashing lights or exhibits noticeable
change in lighting intensity) . Section 430:30, subd. 17, prohibits such signs .
After several warnings, the applicant has complied with our request to turn the
flashing lights off and now is requesting that it be defined as a ''historical
identification symbol '', stating that these lights depict an historical image of a
• movie theater.
ALTERNATIVES : Interpret the ordinance to allow the flashing lights as an historical
symbol or not to be an historical symbol under the intent of the ordinance.
RECOMMENDATION: Staff feels that the intent of allowing historical symbols included
such things as barber poles, mortar and pestle at drug .stores and other small ,
generally recognizable symbols of historically significant value . The lights in
question represent a substantial stretch of that interpretation, do not resemble a
theater marquis and even if in a theater configuration, would -still not be allowed to
flash in my opinion. I recommend that this request not be interpreted to allow the
flashing lights.
ATTACHMENTS :
Plan Application Form
Mailing List X Letters of Support/Objection
Notice of Hearing
CIT MANAGER-SA REVIEW: COMMENTS :
•
