H. Zawieruszynski , owners of the <br /> property at 2608/10 - 37th Avenue N.E. are requesting a variance to the <br /> front yard setback requirement of the City Ordinance to be allowed to <br /> build two double garages at the front of the double bungalow. <br /> The property under consideration as well as the two adjacent properties <br /> all maintain a front yard setback of 35 feet. If the garages are <br /> constructed, they would have a 15 foot front yard setback, therefore, <br /> requiring a 20 foot variance. <br /> The ordinance states that a front yard setback must be at least 30 feet <br /> or equal to the average front yard of the two adjacent lots. The <br /> bungalows on both sides and 2608/10 have a front yard setback of 35 <br /> feet. <br /> Staff is not aware of precedence ever being established for a similar <br /> request. There are homes in the City that have garages that extend in <br /> front of the setbacks of the adjacent properties which have been <br /> grandfathered in. In the area damaged by the tornado, there are some <br /> new homes that do have garages which extend in front of the setbacks of <br /> adjacent structures. Homes damaged during the storm were permitted to <br /> rebuild on their original foundations. <br /> Public Works Supervisor Lorbeski , after examining the proposed <br /> construction area, believes that the underground utilities could be <br /> adversely effected by the construction because there would not be <br /> sufficient ground cover over the utility lines. <br /> :cjk4.17.90 . <br />
