Burt, -City Manager <br /> I T EM : SETBACK VARIANCE REQUEST, JAMES PIRINO, 2917 - 33RD AVE. N.E. <br /> The applicants, James and Harriet Pirino, 2917 - 33rd Avenue N.E. are <br /> requesting a front yard variance of 20 feet from the average front yard <br /> setback ( 53 feet 4 inches) of the two adjacent properties. <br /> The applicant moved a home into St. Anthony from . The original plan <br /> which was submitted. to the building department (Exhibit A) showed the <br /> construction of the garage on the west side of the property equal to the <br /> setback of the two adjacent properties. During the week of March 5th, <br /> Mr. Hamer, the Public Works Director) observed the applicant had begun <br /> construction of the foundation for the garage in the front of the home. <br /> Mr. Hamer subsequently stopped construction of the garage. On March 23 , <br /> 1990, the applicant submitted plans (Exhibit B) for the construction of <br /> the garage on the front of the home. <br /> Mr. Hamer has allowed the applicant to finish the garage foundation so <br /> that they will be able to move forward on grading the lot and finish <br /> work on the home. The applicant understands that all of the block work <br /> is at his own risk (Exhibit C) and it may be ordered out, pending the <br /> outcome of his request. <br /> The ordinance states a front yard must have a depth of at least thirty <br /> (30) feet or equal to the average front yard of the two adjacent lots. <br /> The neighboring homes on the east and west sides of the applicants have <br /> a setback of 5314" . Staff is not aware of precedence ever being <br /> established for a similar request. There are homes in the City that <br /> have garages that extend in front of the setbacks of the adjacent <br /> properties which have been grandfathered in. In the area damaged by the <br /> tornado, there are some new homes that do have garages which extend in <br /> front of the setbacks of adjacent structures. Homes damaged during the <br /> storm were permitted to rebuild on their original foundations. <br /> The applicant does have enough room to construct a single car garage on <br /> the west side of his home that would not require a variance and there is <br /> also space in the back yard for a garage. <br /> :cjk4.17.90 _ <br />
