r t <br /> City Council Meeting Minutes <br /> February 9, 1999 <br /> Page 8 • <br /> 1 Sue Kozarek, 4029 Shamrock Drive, stated she had co-chaired the Storm Water Task Force, <br /> 2 adding this on-going problem did not begin in 1997 with 13 complaints. She stated there have__ <br /> 3 been massive losses in homes from repeated,_numerous-flooding problems.--She added it is <br /> -hurtful-and demoralizing to indicate only a few people have been impacted by flooding. <br /> 5 <br /> 6 Ms. Kozarek stated the task force had reviewed the possibility of a holding pond at the Town& <br /> 7 Country area and decided that solution was not financially feasible within the task force's <br /> 8 perimeters. She added the City has looked long and hard at possible solutions and she expressed <br /> 9 her belief that it is necessary to solve flooding problems in the north end of the City rather than <br /> 10 attempt to beautify the south end. She urged the Council to provide a solution which will be the <br /> 11 fairest for all residents. <br /> 12 <br /> .13 Preston Williams, 2805 Pahl Avenue, asked whether in the context of the assessments of which <br /> 14 he has been notified whether repairs to property damage during the course of construction can be <br /> 15 completed by the individual homeowner and deducted from the assessment. <br /> 16 <br /> 17 Ranallo asked what kind of damage Mr. Williams meant. Mr. Williams stated he was referring <br /> 18 to damage to driveways, lawns, sidewalks, sprinkler systems and other property items. He added • <br /> 19 this issue relates to all the private property along the course of the proposed construction. <br /> 20 <br /> 21 Mr. Hubmer stated some driveways will be reconstructed and large portions of front yards will <br /> 22 be lost in the course of construction,but repairs are completed as part of the project. He.added <br /> 23 the repairs are within the City's right of way limits which have not been exceeded, and repairs <br /> 24 will be completed to the satisfaction of the City. <br /> 25 <br /> 26 Mr. Williams questioned whether the resident's satisfaction-will be considered. Ranallo stated <br /> 27 the most previous of these projects within the City had been completed very satisfactorily and the <br /> 28 Public Works Department was very satisfied with the contractor who will be completing this <br /> 29 project. <br /> 30 <br /> 31 Cavanaugh asked whether Mr. Williams was concerned about the quality of work to be done, or <br /> 32 whether the work will not be done. Mr. Williams stated there is the potential for both to occur. <br /> 33 He expressed concern that the work completed will be to his satisfaction as well as that of the <br /> 34 City. <br /> 35 <br /> 36 City Attorney William Soth stated the repairs are conducted in the City's right of way and costs <br /> 37 incurred are paid to the contractor by the City, adding it would not be appropriate for property <br /> 38 owners to work in the City's right of way.. Faust stated the City will only pay for its standard. <br /> 39 <br /> 40 Cavanaugh asked Ms. Stuhr whether, in her real estate experience, homes with long track records • <br /> 41 of flooding are desirable to potential homeowners.
