Planning Commission Meeting Minutes <br /> May 20, 2003 <br /> Page 2 <br /> 1 VIII. PUBLIC HEARINGS. <br /> 2 8.1 Amend the Zoning Code to Allow Pawnbrokers and Secondhand Goods Dealers as <br /> 3 Conditional Uses in Commercial Districts. <br /> 4 Acting Chair Stille opened the public hearing at 7:05 p.m. <br /> 5 <br /> 6 Ms. Hall noted that the Planning Commission was holding a public hearing to amend Section <br /> 7 1635.03 of the City's Zoning Code to allow for pawnbrokers and secondhand dealers to operate as a <br /> 8 conditional use in Commercial districts within the City. She stated this was necessary because you <br /> 9 would not pass an ordinance allowing pawnbrokers as a conditional use without guidelines in place <br /> 10 in Section 566 to regulate pawnbrokers. <br /> 11 <br /> 12 Ms.Hall stated in regard to the pawnshop and secondhand good ordinance,the City will also need to <br /> 13 amend Chapter 6 of the City Code relating to fees. Both the pawnbroker and secondhand dealer <br /> 14 ordinance reference Section 615 of the City Code as establishing an investigation fee and license fee. <br /> 15 Ms.Hall referred to the proposed ordinance amending 615,which establishes such fees.She noted it <br /> 16 was not necessary for the Planning Commission to consider this ordinance, as it is not a zoning <br /> 17 matter. However to be complete, the Planning Commission should review the proposed fee <br /> 18 ordinance and forward it onto the City Council. The fees were researched and recommended by <br /> 19 Captain John Ohl of the Police Department. <br /> 20 <br /> 21 Ms.Hall explained that on April 15,2003 Planning Commission meeting,a public hearing was held <br /> 22 on the pawnbrokers and secondhand dealers ordinances. She stated there was no public.comment at <br /> 23 the public hearing. <br /> 24 <br /> 25 Ms. Hall indicated staff recommends that the Planning Commission take public comment on the <br /> 26 zoning amendment and then refer it onto the City Council as recommended adoption. Ms. Hall <br /> 27 explained the recommended ordinances, zoning code amendment, and fees will be considered by <br /> 28 the City Council on May 28, 2003. <br /> 29 <br /> 30 Hearing no public comment, Acting Chair Stille closed the public hearing at 7:06 p.m. <br /> 31 <br /> 32 Acting Chair Stille indicated at last months meeting, this was discussed at length and referred the <br /> 33 Commission's rationale for this amendment to the March meeting minutes and comments from <br /> 34 the Police Chief. <br /> 35 <br /> 36 Motion by Acting Chair Stille, second by Commissioner Tillman, to amend Ordinance Section <br /> 37 1635.03 of the Zoning Code to Allow Pawnbrokers and Secondhand Good Dealers as <br /> 38 Conditional Uses in Commercial Districts. <br /> 39 <br /> 40 Motion carried unanimously. <br /> 41 <br /> 42 Ms. Hall indicated this would go to Council on May 28, 2003 for a first reading. <br /> 43 <br />
