MEMORANDUM
DATE: 11/10/03 MEETING DATE: 11/18/03
TO: Chair Melsha & Planning Commission Members
FROM: Susan M.H. Hall, Assistant City Managerd1d
SUBJECT: Adult Day Care in Light Industrial District
Overview:
Last month, Michael Wagner, who owns a professional office building at 2924 Anthony
Lane North, approached the Planning Commission about having an adult day care
center in his building. An adult day care center has approached him about leasing space
in his building. At this time, adult day care is only allowed in the Commercial zoning
district as a conditional use, per an adopted ordinance resolution earlier this year.
As 'a first step in the process, the Planning Commission set a public hearing on
November 18 to consider an amendment to the zoning code to allow adult day care
centers as a conditional use in the Light Industrial district.
One of the concerns to be addressed is what the State looks at when reviewing sites for
adult day care as well as what the differences are between Commercial and Light
Industrial zoning districts in terms of allowed uses in light of this request.
Requested Action:
Staff recommends the Planning Commission take public comment on the zoning
amendment. Attached please find ordinance language if the Planning Commission
recommends moving ahead with the change. The recommendation will be considered
by the City Council on November 25. An ordinance change typically requires three
readings at the City Council level for adoption.
Attachment:
• Adult Day Care amendment language
