CITY OF ST. ANTHONY VILLAGE <br />STATE OF MINNESOTA <br />RESOLUTION 16 -017 <br />A RESOLUTION FINDING A NEGATIVE DECLARATION OF NEED FOR AN <br />ENVIRONMENTAL IMPACT STATEMENT FOR MIRROR LAKE IMPROVEMENTS <br />WHEREAS, pursuant to Minnesota Environmental Quality Board (EQB) Rules, Chapter 4410, <br />part 4410.1000, Subpart 3, the City of St. Anthony Village as the responsible <br />governmental unit completed an Environmental Assessment Worksheet (EAW) <br />for the lake improvements identified in the Mirror Lake Improvements EAW; and <br />WHEREAS, pursuant to Minnesota EQB Rules, Chapter 4410.4300 Subpart 27, the project <br />meets the thresholds for an EAW for wetlands and public waters projects; and <br />WHEREAS, copies of the EAW were distributed to all persons and agencies on the official <br />EQB mailing list prior to November 9, 2015; and <br />WHEREAS, notice of the availability of the EAW for public review for a 30 -day comment <br />period was published in the EQB Monitor on November 9, 2015; and <br />WHEREAS, a press release was published in the St. Anthony Bulletin on November 11, 2015 to <br />announce the availability of the EAW to interested parties; and <br />WHEREAS, the 30 -day comment period ended on December 9, 2015 and all comments <br />received have been considered; and <br />WHEREAS, the EAW, in conjunction with comment responses, identified construction <br />phasing, mitigation, habitat restoration, and water quality improvements that, if <br />met, will address environmental effects on water bodies and wildlife caused as a <br />result of the project. <br />NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of St. Anthony <br />Village that: <br />That it should and hereby does make a negative declaration on the need for an Environmental <br />Impact Statement for the improvements included in the Mirror Lake Improvements EAW, <br />provided all mitigation measures of the EAW are implemented by the developer(s) as part of the <br />projects, and all City of St. Anthony and Rice Creek Watershed District environmental standards <br />are followed and incorporated into the final site plans for the project. <br />
