8 <br />STUDY OF MEDICAL CANNABIS MANUFACTURERS AND CANNABIS FACILITIES <br />CITY OF SAINT ANTHONY VILLAGE <br /> <br />study their potential impact. In addition to placing a moratorium on cannabis facilities, the <br />Interim Ordinance directed City staff to prepare this study. <br />In order to protect the right of the City’s residents to receive lawful medical care, the <br />Interim Ordinance specified that “[n]othing in this Interim Ordinance shall be construed to <br />prohibit any Health Care Practitioner from writing a prescription for Medical Cannabis or any <br />Patient or Registered Designated Caregiver from possessing and administering Medical Cannabis <br />in compliance with the law.” <br />3.0 PURPOSE OF STUDY <br />Because the recent change in the legal status of medical cannabis under Minnesota law <br />and its potential to affect the City’s zoning controls, the City felt the need to conduct this Study. <br />The goals of the Study are as follows: <br />• Determine the status of medical cannabis under the City Code; <br />• Determine the status of medical cannabis manufacturers and facilities under the <br />City’s Zoning Code; <br />• Determine whether the Zoning Code’s application to medical cannabis <br />manufacturers and facilities is consistent with the City’s intent in planning for <br />property use within its zoning districts; <br />• Evaluate the challenges involved with regulating medical cannabis manufacturers <br />and facilities; <br />• Ensure that, if amended, the Zoning Code is improved in regards to consistency <br />and clarity with respect to medical cannabis manufacturers; and <br />• Ensure that the Zoning Code is consistent with state law pertaining to medical <br />cannabis. <br />16
