ANTHONY <br /> COUNCIL MINUTES <br /> December 23, 1969 <br /> The meeting was called to order by the Mayor at 8:00 o'clock P.M. <br /> The following were present: O'Connor, Crouse, Emend, Levandowski, Dougherty <br /> Absent: None <br /> Also Present: Village Attorney, Fred Richards <br /> Village Manager, John R. Printon <br /> Councilman Dougherty noted that the December 9, 1969 minutes as refers to the <br /> Human Relations Committee should read: 'A general breakdown of subject matter <br /> together with the general theme and specific costs should be submitted to the <br /> Council prior to scheduling the program. ' Motion by Councilman Levandowski and <br /> seconded by Councilman Dougherty that the minutes of the December 9, 1969 <br /> meeting be approved as amended. <br /> Motion carried. <br /> The Mayor declared the hearing on supplemental Assessments Improvement-Street <br /> and Storm Sewer 1952-1 and Watermain 1953-1 open. <br /> • A memorandum explaining the fund deficits was reviewed by the Mayor as follows : <br /> Street & Storm Sewer Improvement 1952-1 Deficit not assessed $25,924.04 <br /> An additional $1.00 per front foot levy is necessary to fund the <br /> cost of the improvement. <br /> Watermain Improvement 1953-1 Deficit not assessed $160,637.93 <br /> An additional $2.25 per front foot levy is necessary to fund the cost <br /> of the improvement. <br /> Street and Storm Sewer Improvement 1952-1 was first discussed. Inquiry was made <br /> by residents at 3012-32nd Avenue N.E. and 2505-34th Avenue N.E. as to whether <br /> their property was included in the street assessment, a search of the assessment <br /> list indicated they were not. Mr. Patrick Conway spoke against the assessment <br /> and he was informed that he was not in the assessment area. Mr. Albrecht, 2503 <br /> 33rd Avenue N.E. inquired as to the policy of assessing corner properties. Mr. <br /> Frani; Bracchi, 3108 Silver lake Road, inquired as to why the assessment was not <br /> corrected previously. Fib was informed that the present Council vias informed <br /> of the matter in 1968 and at that time ordered a reviewal of the assessment <br /> procedure used on the improvements in deficit. Mr. Kempfer, 3413-34th Avenue N.E. <br /> asked if the total cost was known in 1952. He was told that the cost would be <br /> 1;nown :prior to an assessment hearing. A resident at 3012-32nd Avenue N.E. felt <br /> that the deficit should be paid on a Village wide basis. Mr. Norman Cavanagh <br /> objected to being included in the assessment for the improvement. Mr. Bracchi <br /> inquired of the Village Attorney as to the legality of an assessment for a street <br /> when his property was on a County Road. He was told the Council has the power to <br /> assess a benefit if it is not arbitrary. Mr. Charles Kausel felt that the deficit <br />
