ANTHONY <br /> COUNCIL MINUTES <br /> August 9, 1977 <br /> The meeting was called to order by Councilman Sauer, Acting Mayor <br /> Pro Tem, at 7: 35 P.M. <br /> Present for roll call: Sauer, Haik and Sundland <br /> Absent: Miedtke and Stauffer <br /> Also present: Jim Fornell, Acting City Manager <br /> Motion by Councilman Haik and seconded by Councilman Sundland to <br /> approve the minutes for the July 26 , 1977 Council meeting. <br /> Motion carried unanimously. <br /> An agenda addition dealing with the conveyance problems of Mr. and <br /> Mrs. Edwin Buetz was then considered. Mr. and Mrs. Buetz were <br /> present but C.W. Bartlett of Speciality Equipment Company presented <br /> the preliminary plans for the car wash they had been granted a <br /> building permit to construct on Lot 1, Block 1, Apache Plaza Second <br /> Addition, which is required to be replatted before construction can <br /> begin. The car wash equipment dealer said he understood from a con- <br /> versation he had with Mr. Vickrey that day, that if Apache from whom <br /> the property had been purchased gave Mr. and Mrs. Buetz a letter of <br /> agreement to the replatting and the Buetzes were willing to post a <br /> bond to insure the replatting, the City would be able to grant <br /> permission for construction to begin. <br /> Mr. Fornell then advised Mr. and Mrs. Buetz there are dropped special <br /> assessments amounting to approximately $4, 638. 00 on Lot 1, Block 1, <br /> Apache Plaza Second Addition, which the City intends spreading against <br /> the property which they purchased and it will be their responsibility <br /> to ascertain whose responsibility it is to pay such assessments . <br /> Motion by Councilman Sundland and seconded by Councilman Sauer to <br /> approve the preliminary replat of Mr. and Mrs. Edwin Buetz of Lot 1, <br /> Block 1, Apache Plaza Second Addition and to issue the car wash build- <br /> ing permit, subject to concurrence of the City Attorney, receipt of <br /> the letter of agreement from Apache Corporation and a deposit of <br /> $700.00 to assure the replatting of the property in accordance with <br /> City ordinances and to direct the City Attorney to review the title <br /> to the property. <br />
