• the land description was by metes and bounds and thereby violated State <br /> statutes and he finished by saying "such reassessing can't be done 10 <br /> years after the fact" . <br /> Mr. Fornell responded to the attorney's contention that the same reassess- <br /> ment notice had been sent to the property owners before the Beutz plat <br /> had been filed. <br /> Bruce Odlaug, 332 Hamm Building, St. Paul, identified himself as repre- <br /> senting the interest of Northern Gopher Enterprises who are protesting <br /> the reassessments against the Diamond 8 property. It was his contention <br /> that the City was negligent in responding to Ramsey County's inquiries <br /> regarding the original assessments . He cited a case in Hennepin County <br /> where Minneapolis has certified an error in street assessments and where <br /> the court had upheld the rights of the property owner. He felt it was <br /> "grossly unfair to make the present owner pay for assessments which <br /> were not collected because of the City's negligence" and also insisted <br /> the assessments should be the prior owner's responsibility. <br /> The City' s counsel responded to this by saying "assessments are made <br /> against property and not owners" . He contended that the only way the <br /> City will determine where its rights lie is to adopt the assessments <br /> rolls and certify them to the auditor for collection. He said the City <br /> had pondered during many public meetings what disposition should be made <br /> of the unpaid improvement costs and finally had concluded it was the <br /> • responsibility of the City in fairness .to all its residents to collect <br /> the amounts still owing. <br /> R.J. Kleinman, manager of the Diamond 8 Apartments said the City also had <br /> a responsibility to its residents who live in those apartments and who <br /> will have to pay an additional $83.00 a year in rent for the next 10 years <br /> since this amount was not included when the rentals were established <br /> for those units.
