While only future monitoring will determine the <br /> relationship between any written testing procedure and adverse <br /> impacts, at this time it appears that future adverse impact can be <br /> sufficiently reduced by the following changes: <br /> a. The elimination of the AP Predictor from <br /> any written testing procedure. <br /> b. The elimination of cut-scores from any <br /> written testing procedure such that every <br /> .applicant passing the agility or physical test <br /> and the oral interview, are on the eligibility <br /> list. <br /> c. The elimination of all language or content <br /> of any written testing procedure which <br /> references minority races or is racially <br /> offensive in any manner. <br /> d. The monitoring of adverse impact and <br /> compliance with the currency obligations as • <br /> required by the EEOC Guidelines. <br /> e. The continuing jurisdiction of this court <br /> (directly or through a special master) <br /> relative to these issues. <br /> CONCLUSIONS OF LAW <br /> 1. Defendants are liable, jointly and severally, to each <br /> plaintiff for actual damages in the following amounts: <br /> Plaintiff John Starks: $81, 262 <br /> Plaintiff Chris Fields: $75, 426 <br /> 2 . Defendants are subject to the orders of this court with <br /> respect to remedying past and future discrimination and attendant <br /> adverse impact. <br /> 3 . Defendants are liable, jointly and severally, for <br /> reasonable attorneys fees, costs and other damages of plaintiffs in <br /> respect to their prosecution of the claims herein, to be determined <br /> at a hearing to be held on December 21, 1995 at 8 : 30 a.m. <br /> 4 . Defendant MPRS is liable to each plaintiff for punitive <br /> damages in the amount of $8 , 500. <br /> 6 <br />
