13 <br /> STAFF REPORT <br /> • To: Michael Mornson, City Manager <br /> From: Kim Moore-Sykes, Management Assistant Rob <br /> Date: June 22, 1999 <br /> Subject: Year 2000 Legislation for Local Units of Government in Addressing Y2K. <br /> On May 25, 1999 the Governor signed legislation enacted by the 1999 Legislature that offers <br /> local units of government assistance and protection in their attempts to mitigation the <br /> potential effects of possible Year 2000 problems. This legislation that is found in Ch. 250, <br /> Article 2, Sections 6-7, provides for the following: <br /> • exemption from the Uniform Municipal Contracting Law (MN Statutes, Sec. <br /> 471.345) <br /> • ability for a local government unit to issue Year 2000 debt above the Debt Limit <br /> • provides for Year 2000 loan fund. <br /> In order for the City to participate in any or all of these provisions, the City is required to <br /> provide notification or certification to the Minnesota Department of Administration. This <br /> notification or certification is'done by completing any of the attached forms and submitting <br /> both the form and a resolution supporting the request to the Minnesota Year 2000 Project <br /> Office. <br /> Exemption from Uniform Municipal Contracting Law. (Ch. 250,Article 2, Section 6): This <br /> section of the Year 2000 Legislation states that the Uniform Municipal Contracting Law does <br /> not apply to the purchase or rental of supplies, materials, and equipment nor to construction, <br /> alteration, repair, and maintenance of real or personal property when the governing body of a <br /> municipality determines that there is an urgency due to the actual or potential failure or <br /> malfunction of public infrastructure or systems that are critical to the provision of municipal <br /> services due to Year 2000 problems with computers and electronically controlled devices. <br /> This section goes on to further state that a contract exempted from the Minnesota Statues by <br /> this legislation may, at the discretion of the municipality, be made by direct negotiation by <br /> obtaining two or more quotes or in the open market. All quotations shall be kept on file <br /> . for a period of at least one year after receipt. <br />
