They informed me that <br /> in most of the cases they have been involved with, the award for value from the <br /> Commissioners favored the property owner's value. <br /> The tentative cost to file a condemnation case is estimated as follows: <br /> 1. Attorney fees, filing, etc. $15,000 <br /> 2. Appraisals of property: $4,500 <br /> • 3. Title work, plus offer $1,500 <br /> 4. Testimony from witnesses, WSB & Associates, <br /> appraisals, plus Evergreen $2,500 <br /> $23,500 <br /> This estimated cost does not include expenditures that would be related to an appeal of the <br /> Commissioner's award by either party. <br /> Evergreen plays a minor role in condemnation, if any. The attorney and the appraiser would <br /> play the largest role. It is recommended that the City would need to get another appraisal of <br /> the properties as well as pay for up to $500 for each of the property owners' appraisals. <br /> Matt Storm of Evergreen felt that the Kuharski's and the City are closer in value than the <br /> Tuohy's and the City. One option would be to attempt to purchase Kuharski's property <br /> through continued negotiations and either condemn Tuohy's properties or walk away from his <br /> property and address his property when the market changes. <br /> The one factor that will increase our cost in the Tuohy condemnation is he has two renters in <br /> • the houses. As a result, we would need to pay relocation costs to the renters as well as help <br /> them find new places to rent. This would also increase our out-of-pocket costs. That's not <br /> included in the $23,500. <br />
