RESOLUTION NO. 65 - 007 <br /> RESOLUTION TO ABANDON AND VACATE A PORTION OF BELDEN DRIVE <br /> WITHIN THE VILLAGE OF ST. ANTHONY <br /> WHEREAS a petition has been presented to this Council by a majority <br /> of the owners of the lots orbutting up on Belden Drive Circle requesting that <br /> said circle be vacated, <br /> WHEREAS, notice of a Public Hearing thereon has been given according to low, <br /> and said hearing held on Tuesday, January 12, 1965 and all parties interested <br /> therein having had an opportunity to be heard and, <br /> WHEREAS, the Village Council has determined that due to the nature of the <br /> development of the abutting property, said circle is no longer needed to serve <br /> the public purpose for which it was originally intended, <br /> BE IT FURTHER RESOLVED by the Village Council of the Village of St. Anthony <br /> as follows: <br /> 1. That the Village abandons and vacates as a public street and right of way <br /> the following portion of Belden Drive as is contained in the plat of <br /> Belden Terrace Second Addition, except that the said Village retains <br /> easement rights for street, boulevard and utilities purposes over the <br /> entire portion vacated, said portion described as follows: <br /> 40 "All that part of Belden Drive, as dedicated and laid out in the plot of <br /> Belden Terrace Second Addition, Hennepin County, Minnesota which is <br /> on file and of record in the office of the Registrar of Titles in and for <br /> said Hennepin County, which lies Southeasterly of a line which is 60' <br /> SEIy of and parallel with the SEIy lines of lots 1 and 2, Block 1, Belden <br /> Terrace Second Addition." <br /> 2. That the Village be held harmless for any damages to private property, <br /> extending over easement,caused during maintenance of said utilities. <br /> 3. That a certified copy of this Resolution may and shall be filed by the <br /> Clerk of this Village with the proper County Officers and that upon such <br /> filing, the abandonment and vacation of such streets as public right of way <br /> shall be completed. <br /> Adopted this 9th day of February, 1965. <br /> M or <br /> ATTEST: `�--- <br /> 'A e'Ll— 2 <br /> e <br /> Mana <br />
