RESOLUTION N06 65-038 • RESOLUTION ORDERING IMPROVEMENT 7419-65-1 WHEREAS, the Village Council of St. Anthony Village has been informed by the Minnesota Highway Department that sewer and water utility lines located under State Trunk Highway No. E hear the intersection of 29th Avenue must be relocated and reconstructed from 29th Avenue (County Road "C") to the north for a distance of approximately 100 feet, which work must coincide with the improvement of State Trunk Highway No. 8; and, WHEREAS, the utilities are presently located in the right of way of State Trunk Highway No. 8 pursuant to permit issued by the Minnesota Highway Department, which permit provides that the cost of relocation of the utilities must be borne by the permitee; and, WHEREAS, the sole property served by the utilities is occupied by Medtronics, Inc., and is described as: That part of the Southwest Quarter-(SW 4) of Section Thirty-one (31 ), Township Thirty (30), Range Twenty-three (23), described as follows: Commencing at a point in the East line of said Southwest Quarter (SW4) distant 1540.94 feet North of the intersection of said East line with the Northerly right of way line of the Soo Line Railroad; thence hest 284.55 feet; thence North 10-00' East 200 feet; thence East 281.30 feet to the East line of said Southwest Quarter 0144); thence South 00-04' West along the East line of said Southwest Quarter (SW 4) a distance of 199.97 feet to the point of commencement, subject to easement for street purposes in Silver Lake Road. For the purpose of this description the East- line of said Southwest Quarter (Sly) is assumed to bear South 00-04' West, said permit subject to the conditions as outlined in the Council Minutes of April 13, 1965. WHEREAS, the initial installation of the improvement was accomplished by the landowner pursuant to agreement with the St. Anthony Village Council that in the event of future relocation, the cost of the relocation would be borne by the landowner; and, WHEREAS, the representatives of Medtronics, Inc. appeared at the April 13 meeting of the St. Anthony Village Council and acknowledged the necessity to comply with the request of the Minnesota Highway Department to relocate the utility lines at an estimated cost of $3,323.79; and, WHEREAS, the Village Council fixed the date of April 27, 1965, for Council hearings on Improvement 7419-65-1; and, WHEREAS, mailed and published notice of the improvement hearing was given to the landowner, and at the hearing all persons desiring to be heard were given an opportunity to be heard, and none appeared in opposition to the improvement; •
