h <br /> AGREEMENT made this day of f�r� 1924, <br /> between the Northern Pacific Railway Company, hereinafter called <br /> the "Railway Company" , and the Board of Park Commissioners of the <br /> City of Minneapolis , hereinafter called the "Park Board". <br /> WHEREAS, the so-called at . Anthony Boulevard crosses the <br /> tracks of the Minneapolis branch of the Railway Company outside of <br /> and near the northerly city limits of the City of Minneapolis, Min- <br /> nesota; and <br /> "PHEREAS, it is desired that an overhead highway bridge be <br /> constructed at the point of crossing and that the use of a grade <br /> crossing be avoided; and <br /> ?"WHEREAS, the Railway Company desiring at a future date to <br /> '• change the grade of its tracks at and in the vicinity of the <br /> point of crossing permitting a change in the grade of the higP way <br /> the parties hereto have deemed it advisablefirst to construct a <br /> timber bridge ; <br /> NOW THEREFORE, in consideration of the mutual dependent <br /> promises herein set forth, the parties hereto agree as follows: <br /> 1. The location of said overhead bridge is correctly <br /> shown in the sketch attached hereto, marked "Exhibit A" and iden- <br /> tified by the signatures of the Chief Engineer of the Railway <br /> Company and the Engineer of the Park Board. <br /> 2. The Railway Company shall, at its sole expense, con- <br /> struct and complete on or before April 1, 1924, timber bridge <br /> shown on Exhibit A. <br /> 3. At any time subsequent to April 1, 1934, the Railway <br /> • Company shall , on demand from the Park Board, replace said bridge <br /> with a bridge of concrete, steel or a combination of these materials, <br /> 'i <br /> at its sole cost and expense. <br /> 4. The ?4ai lway Company shall maintain said temporary <br /> bridge at its sole cost and expense. <br />
