RESOLUTION NO. 69-043 <br /> RESOLUTION CALLING FOR A PUBLIC HEARING ON <br /> THE SUPPLEMENTAL ASSESSMENTS TO CORRECT <br /> OMISSIONS IN THE ASSESSMENT OF THE TOTAL <br /> COST OF STREET IMPROVEMENT 1952-1 AND <br /> WATER MAIN IMPROVEMENT 1953-1 <br /> WHEREAS, the State Public Examiner has ascertained that the total cost of <br /> certain improvements undertaken by the Village of St. Anthony in the years 1952 <br /> and 1953 were not assessed 100% against benefited lands; and, <br /> WHEREAS, the State Public Examiner has informed the Council of the dollar <br /> amount which must presently be assessed in order to obtain the funds for the total <br /> cost of the improvements as follows : <br /> Street Improvement 1952-1 Supplemental <br /> Assessment $ 25,924.04 <br /> Water Main Improvement 1953-1 <br /> Supplemental Assessment 160,637.93 <br /> and, <br /> WHEREAS, the failure to assess 100% of the project cost has resulted in and <br /> will continue to require that the payment of the dollar amount of the omitted <br /> • assessment be paid out of the general tax funds of the Village or by transfers from <br /> the water utility account; and <br /> WHEREAS, it has been the consistent policy of the Village in subsequent <br /> years and in the case of projects in other areas of the Village where similar <br /> water and street improvements have been constructed to assess 100% of the project <br /> costs against the benefited lands; and, <br /> WHEREAS, the Public Examiner noted that transfers from the Water Utility <br /> Fund to pay the unassessed amounts are not adequate to meet the payments on the <br /> general obligation bonds and waterwork revenue bonds issued by the Village; and, <br /> WHEREAS the Council , upon receipt of the above ii-ormation from the State <br /> Public Examiner, requested the Clerk to ascertain the dollar amount of the <br /> supplemental assessments required to assess 100% of the project costs of Street <br /> Improvement 1952-1 and Water Main Improvement 1953-1 together with the lands <br /> previously assessed for a portion of the costs of said improvements; and, <br /> WHEREAS, the Clerk has reported that the dollar amounts, the proposed <br /> supplemental assessments, and the benefited areas are known and the information on <br /> file in his office; <br /> NOW THEREFORE, BE IT RESOLVED that a public hearing be held at 8:00 P.M. <br /> on December 23, 1969, in the Village Hall to pass upon the proposed supplemental <br /> assessments to correct omissions of earlier Councils and at such time and place, <br /> all persons owning property previously assessed for a portion of the total cost of <br /> the improvements and to be assessed for the omitted costs of Street Improvement <br /> 1952-1 and Water Main Improvement 1953-1 , will be given an opportunity to be heard <br /> with reference to the supplemental assessments as required by Minnesota Statutes <br /> Section 429.071. The Clerk is directed to cause notice of the hearings on the <br />
