18. AFFIRMATIVE ACTION AND EQUAL OPPORTUNITY <br /> A. During the performance of this Agreement, Provider agrees to the <br /> following: In accordance with the Hennepin County Affirmative Action <br /> Policy and the County Commissioners' Policies Against Discrimination, <br /> no person shall be excluded from full employment rights or <br /> participation in, or the benefits of, any program, service or activity <br /> on the grounds of race, color, creed, religion, age, sex, disability, <br /> marital status, affectional/sexual preference, public assistance <br /> status, ex-offender status, or national origin; and no person <br /> protected by applicable federal or state laws against discrimination <br /> shall otherwise be subjected to discrimination. <br /> B. Provider will furnish all information and reports required to comply <br /> with the provisions of 24 CFR Part 570 and all applicable state and <br /> federal laws, rules, and regulations pertaining to discrimination and <br /> equal opportunity. <br /> 19. NON-DISCRIMINATION BASED ON DISABILITY <br /> A. Provider shall comply with Section 504 of the Rehabilitation Act of <br /> 1973, as amended, to ensure that no otherwise qualified individual <br /> with a handicap, as defined in Section 504, shall, solely by reason of <br /> his or her handicap, be excluded from participation in, be denied the <br /> benefits of, or be subjected to discrimination by Provider receiving <br /> assistance from the City under Section 106 and/or Section 108 of the <br /> Housing and Community Development Act of 1974, as amended. <br /> B. When and where applicable, Provider shall comply with Public Law 101- <br /> 336 Americans With Disabilities Act of 1990, Title I "Employment, " <br /> Title II "Public Services" - Subtitle A, and Title III "Public <br /> Accomodations and Services Operated By Private Entities" and all <br /> ensuing federal regulations implementing said Act. <br /> 20. LEAD-BASED PAINT <br /> Provider shall comply with the Lead-Based Paint notification, inspection, <br /> testing and abatement procedures established in 24 CFR 570.608. <br /> 21. FAIR HOUSING <br /> Provider shall be prohibited from receiving CDBG funds for Activities <br /> subject to this Agreement if it impedes actions taken by the City to comply <br /> with the City's fair housing certification. <br /> 22. LOBBYING <br /> A. No Federal appropriated funds have been paid or will be paid, by or on <br /> behalf of Provider, to any person for influencing or attempting to <br /> influence an officer or employee of any agency, a Member of Congress, <br /> an officer or employee of Congress, or an employee of a Member of <br /> Congress in connection with the awarding of any Federal contract, the <br /> 6 <br />
