B. The Subrecipient will furnish all information and reports required to <br /> comply with the provisions of 24 CFR Part 570 and all applicable state <br /> and federal laws, rules, and regulations pertaining to discrimination <br /> and equal opportunity. <br /> 19. NON-DISCRIMINATION BASED ON DISABILITY <br /> A. The Subrecipient shall comply with Section 504 of the Rehabilitation <br /> Act of 1973, as amended, to ensure that no otherwise qualified <br /> individual with a handicap, as defined in Section 504, shall, solely <br /> by reason of his or her handicap, be excluded from participation in, <br /> be denied the benefits of, or be subjected to discrimination by the <br /> Subrecipient receiving assistance from the Recipient under Section 106 <br /> and/or Section 108 of the Housing and Community Development Act of <br /> 1974, as amended. <br /> B. When and where applicable, the Subrecipient shall comply with, and <br /> make best efforts to have its third party providers comply with, <br /> Public Law 101-336 Americans With Disabilities Act of 1990, Title I <br /> "Employment," Title II "Public Services" - Subtitle A, and Title III <br /> "Public Accommodations and Services Operated By Private Entities" and <br /> all ensuing federal regulations implementing said Act. <br /> 20. LEAD-BASED PAINT <br /> The Subrecipient shall comply with the Lead-Based Paint notification, <br /> inspection, testing and abatement procedures established in 24 CFR 570.608. <br /> 21. FAIR HOUSING <br /> The Subrecipient shall be prohibited from receiving CDBG funds for <br /> activity/ies subject to this Agreement should it not affirmatively further <br /> fair housing within its own jurisdiction or impede action taken by <br /> Recipient to comply with the fair housing certification. <br /> 22. LOBBYING <br /> A. No federal appropriated funds have been paid or will be paid, by or on <br /> behalf of the Subrecipient, to any person for influencing or <br /> attempting to influence an officer or employee of any agency, a Member <br /> of Congress, an officer or employee of Congress, or an employee of a <br /> Member of Congress in connection with the awarding of any Federal <br /> contract, the making of any Federal Grant, the making of any Federal <br /> loan, the entering into of any cooperative agreement, and the <br /> extension, continuation, renewal, amendment, or modification of any <br /> Federal contract, grant, loan, or cooperative agreement. <br /> • <br /> 8 <br />
