RESOLUTION 91-04 <br /> 9 <br /> • RESOLUTION VACATING A PORTION OF <br /> AN EASEMENT FOR STREET AND UTILITY PURPOSES <br /> (Diamond 8 Apartments) <br /> After discussion of a motion by Councilmember Marks <br /> to vacate a portion of certain street and utility easements, it was deemed in the <br /> interest of the public to grant the vacation. Council member Marks <br /> introduced the following resolution and moved its adoption: <br /> BE IT HEREBY RESOLVED by the City Council of the City of St. Anthony that <br /> the easement for street and utility purposes created by that certain Final <br /> Certificate dated February 14, 1963, approved February 15, 1963 and filed in the <br /> office of the Ramsey County Registrar of Titles on February 28, 1963 as <br /> Document No. 453362 is hereby declared and ordered vacated and <br /> discontinued as to, but only as to, the property decribed on Exhibit A attached <br /> hereto and made a part hereof. <br /> And that the City Clerk be directed to prepare and present to the proper <br /> county offices notice of said vacation. <br /> . The motion for adoption of the foregoing resolution was seconded by <br /> Councilmember Felming and upon a vote being taken <br /> thereon the following voted in favor thereof: Marks, Fleming. Enrooth <br /> and Wagner , and the following voted <br /> against the same: None <br /> Whereupon the resolution is duly passed and adopted. <br /> Adopted the 28th day of September, 199 <br /> Mayo Pro Tem <br /> ATTEST: <br /> C' Clerk <br />
