CITY OF ST. ANTHONY <br /> • RESOLUTION 01-055 <br /> A RESOLUTION APPROVING THE APPRAISED VALUES OF THE THREE <br /> PROPERTIES RELATING TO THE CONDEMNATION ACTIONS FOR THE <br /> PROJECT KNOWN AS THE HARDING STREET PONDING PROJECT <br /> BE IT RESOLVED by the City Council of the City of St. Anthony, Minnesota <br /> (the "City"), <br /> WHEREAS, the City owns and operates a municipal storm sewer utility (the <br /> "Utility") pursuant to Minnesota Statutes, Section 444.015; <br /> WHEREAS, in connection with the construction of improvements to the Utility <br /> (the "Harding Street Ponding Project") it is necessary for the City to acquire perpetual <br /> utility and ponding easements and a temporary easement over a portion of certain <br /> property in the City; <br /> WHEREAS, the City has initiated an eminent domain action in Hennepin County <br /> District Court to acquire the required easements, and is pursuing a"quick-take" <br /> condemnation action, pursuant to Minnesota Statutes, Section 117.042; and <br /> • WHEREAS, the City will be required to pay or deposit into Court its approved <br /> appraisal values for the easements in question in order to proceed with the quick-take. <br /> NOW, THEREFORE, BE IT RESOLVED, that in order to complete the quick- <br /> take of the easements required for the Harding Street Ponding Project pursuant to <br /> Minnesota Statutes, Section 117.042, the City hereby approves the following appraisal <br /> values for the followinLy easements: <br /> A. Parcel No. 5 -Emmett A. and Mary K. Swanson $60,000 <br /> B. Parcel No. 10-Jeffrey A. and Susan R. Wenker $21,000 <br /> C. Parcel No. 11 -Jeffrey D. and Barbara E. Johnson $30,000 <br /> BE IT FURTHER RESOLVED, that the City Manager is authorized, upon <br /> notification from the attorneys for the City'that such a step is necessary, to pay the <br /> • approved easement amounts to the property owners or to deposit them into Court, for the <br /> purpose of completing the quick-take condemnation pursuant to Minnesota Statutes, <br /> Section 117.042. <br />
