Mr. Hunt has offered to settle and sign the easement for <br /> $3,000.00. <br /> • Our offer was $1,500.00 and was based on an appraisal of the property. The appraisal <br /> stated that every effort to protect trees, shrubs and plantings will be made, and if <br /> damaged of destroyed, the items will be replaced. Mr. Hunt has extensive plantings of <br /> flowers, shrubs and trees. He will attempt to move some of the flowers and shrubs, but <br /> will not be able to move them all. Our agreement will be that this settlement will be <br /> payment for any losses, no replacements. <br /> Mr. Hunt also has a swimming pool in his back yard. He feels he will have to have it <br /> cleaned numerous times during construction that would otherwise not have to be done. <br /> This will also be additional costs for him directly related to the project. <br /> In discussing this with Mr. Todd Hubmer, he stated that the temporary area will be staked <br /> in hopes that Mr. Hunt can remove as many plantings as possible, but not having to <br /> replace them will save time and money. <br /> I have also discussed this with Mr. David Treaver. He stated that we cannot litigate the <br /> matter for less then $3,000.00 and it would be uneconomical to settle any other way. <br /> Successfully serving our clients since 1972 <br />
