CITY OF ST. ANTHONY VILLAGE <br /> RESOLUTION 02-068 <br /> A RESOLUTION TO APPROVE VARIANCE REQUESTS <br /> FOR 3015 —37TH AVENUE NE <br /> WHEREAS, at their October 15, 2002 meeting,the Planning Commission recommended the <br /> Council deny the following two variance requests from Business Data Record <br /> Services/Belair Excavating for 3015 —37h Avenue NE; <br /> 1) A building height variance of 9 feet for a proposed 44 foot building <br /> height; and <br /> 2) A side yard variance request of 30 feet(along Macalaster Drive) for a <br /> proposed 5 foot side yard adjacent to a street. <br /> WHEREAS, the City Council having due consideration for the recommendation of the <br /> Planning Commission has reviewed the variance requests and believes that the <br /> utility easement and railroad easement over the property,the new water retention <br /> • panel required to be located on the property in connection with the construction of <br /> the proposed building and the configuration of the lot present an undue hardship <br /> because of circumstances unique to the property not created by the owners of the <br /> property and the variances if granted will not alter the essential character of the <br /> City. <br /> NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of St. Anthony <br /> hereby approves the above variance requests for the property located at 3015 —37`" Avenue NE. <br /> Adopted this o? of day of OC► oex' , 2002. <br /> Mayor <br /> ATTEST: <br /> City Clerk <br /> Reviewed for Administration: <br /> • City Manager <br />
