CITY OF ST.ANTHONY VILLAGE <br /> • RESOLUTION 03 -052 <br /> A RESOLUTION RELATING TO CONDITIONAL USE PERMIT <br /> REQUESTS FOR THE PROPOSED REDEVELOPMENT OF THE CORNER <br /> OF KENZIE TERRACE AND HIGHWAY 88 <br /> WHEREAS, two conditional use requests from Amcon Construction for the redevelopment of the corner of <br /> Kenzie Terrace and Highway 88(Stonehouse/Fire Department properties)were presented to the <br /> St.Anthony Planning Commission at a public hearing on July 15,2003: <br /> 1. Restaurant location.This is a permitted conditional use for a commercial district. <br /> The request is for a location less than 250 feet from a residential district. <br /> Following are the conditions the Planning Commission recommended for <br /> Council approval: <br /> a. Garbage areas must be enclosed with materials that match buildings and <br /> must be located on the southwest corner. <br /> b. Lighting must be"down-spill",with no spillage to residential properties <br /> across Kenzie Terrace and conform with adjacent area(St.Anthony <br /> Boulevard) <br /> C. Hours for outdoor seating shall not exceed 10:00 pm <br /> d. No music or other artificial noise shall be audible from any residential <br /> district <br /> e. City engineers must approve the plan, including a determination that the <br /> proposed plan will not have an adverse impact on the current water run- <br /> of situation <br /> f. The patio will be on the east side of the building <br /> g. Break up mass and improve the landscape to the north side of the <br /> building <br /> h. The design of the building shall conform to Savage Store <br /> i. Hours of operation shall coincide with liquor service hours <br /> 2. On-sale liquor store.This is a permitted conditional use for a commercial district <br /> and no conditions were added for Council approval. <br /> NOW,THEREFORE,BE IT RESOLVED that the City Council of the City of St.Anthony hereby approves the <br /> conditional use requests from Amcon Construction for redevelopment of the comer of Kenzie Terrace and Highway <br /> 88,as recommended by the Planning Commission at their July 15,2003 meeting,and with Amcon's conformity to <br /> the conditions stated above. <br /> Adopted this 2,_day of /l <br /> Mayor <br /> ATTEST: <br /> City Clerk <br /> • Reviewed for Administration: <br /> ity Ma er <br />
