CITY OF ST. ANTHONY <br /> • RESOLUTION NO. 05-034 <br /> RESOLUTION RELATING TO A THIRD AMENDMENT TO A <br /> REDEVELOPMENT AGREEMENT BY AND AMONG THE CITY OF SAINT <br /> ANTHONY,MINNESOTA,THE HOUSING AND REDEVELOPMENT <br /> AUTHORITY OF THE CITY OF SAINT ANTHONY, MINNESOTA, AND APACHE <br /> REDEVELOPMENT, LLC (THE "DEVELOPER"), DATED DECEMBER 19, 2003. <br /> WHEREAS,the City of St. Anthony(the"City") and the St. Anthony Housing and <br /> Redevelopment Authority entered into the referenced agreement regarding an area located <br /> in the northwest portion of the City(the"Agreement"); and <br /> WHERAS, under the terms of the Agreement, certain rights under the Agreement were <br /> assigned to St. Anthony Retail Development, LLC (the"Commercial Developer"); and <br /> WHEREAS, Section 5.16 of the Agreement preliminarily identified how certain costs, in the <br /> amount of$1,705,000, for public improvements benefiting property owned by the <br /> Commercial Developer will be paid for by special assessments; and <br /> WHEREAS, the Commercial Developer is nearing completion of the improvements it is <br /> • required to construct under the Agreement; and <br /> WHEREAS,the Commercial Developer has requested that the Agreement be amended to <br /> reflect the final prorated share of assessments based on the actual square footage of the <br /> constructed improvements. <br /> NOW, THEREFORE, BE IT RESOLVED, by the City of St. Anthony, Minnesota as <br /> follows: <br /> That the Mayor and City Manager are authorized to enter into a Third Amendment to <br /> Redevelopment Agreement by and among the City of Saint Anthony, Minnesota, the <br /> Housing and Redevelopment Authority of the City of Saint Anthony, Minnesota, and <br /> St. Anthony Retail Development, LLC (as Assignee). <br /> Adopted this 12`h day of April, 2005. <br /> jayor <br /> ATTEST: &&aAjVW <br /> City Clerk <br /> Review for Administration: <br /> • City Manager <br />
