• CITY OF ST. ANTHONY VILLAGE <br /> RESOLUTION 05-064 <br /> A RESOLUTION TO DENY VARIANCE TO SIDE YARD SETBACK TO INSTALL AN <br /> EGRESS WINDOW AT 2909 — 30TH AVENUE <br /> WHEREAS, the St. Anthony Planning Commission held a public hearing on <br /> August 16, 2005, regarding a request for a variance to side yard <br /> setback to install an egress window at 2909 — 30th Avenue; and <br /> WHEREAS, the Planning Commission recommended approval of the variance to <br /> the side yard setback to install an egress window at 2909 — 39th <br /> Avenue with the following: <br /> a) The applicant maintains the drainage run-off on the property <br /> b) The applicant's willingness to construct a privacy fence for <br /> safety issues that were presented; <br /> c) The structure was built before the existing building code; <br /> • d) The egress window will enhance life saving opportunities <br /> e) Undue hardship not caused by the applicant but by construction <br /> of the structure. <br /> NOW, THEREFORE BE IT RESOLVED, the Planning Commission recommended <br /> Council denies the request for a variance to side yard setback to <br /> install an egress window at 2909 — 30th Avenue; and <br /> Adopted this 23t day of August, 2005. <br /> Mayor <br /> ATTEST: <br /> City Clerk <br /> Review for Administration: <br /> 40it4aa r <br />
