CITY OF ST. ANTHONY <br /> RESOLUTION 05-066 <br /> • A RESOLUTION APPROVING A VARIANCE FOR BUILDING SETBACK FOR THE <br /> DEVELOPMENT LOCATED AT 2900 KENZIE TERRACE <br /> WHEREAS, the St. Anthony Planning Commission held a public hearing on August 16, <br /> 2005, regarding a variance for building setback for the development located at <br /> 2900 Kenzie Terrace; and <br /> WHEREAS, the Planning Commission had the following findings: <br /> 1. One rear yard setback (northwest corner of building) variance of 12 feet for <br /> a proposed setback of 5 feet at the property line. <br /> Undue hardship exists based on the following: <br /> a. The property is currently somewhat blighted, poorly planned with <br /> regard to layout and is an overall detriment to the area. <br /> b. Undue hardship exists and is a result of an oddly shaped parcel that <br /> is generally triangular in shape with a rounded side. <br /> c. These circumstances were not caused by the applicant or property <br /> owner. <br /> d. The variance, if granted, would not alter the essential character of the <br /> • locality, but would allow for a redevelopment of a blighted site with <br /> new, more aesthetically pleasing buildings. The property cannot be <br /> put to reasonable use without the requested variance because even <br /> reconstructing the existing blighted buildings on their same footprints <br /> would require setback variances. <br /> e. Economic consideration alone is not the reason for the variance <br /> request <br /> f. Because of the overall shape of the parcel, the property cannot be <br /> put to reasonable use without the need for variances. <br /> g. Granting of the variance will keep within the spirit and intention of the <br /> zoning code and further, it is with the City's Comprehensive Plan and <br /> continues the City's economic redevelopment efforts in this area. <br /> NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of St. Anthony <br /> hereby approves the variance for building setback for the development located <br /> at 2900 Kenzie Terrace as recommended by the Planning Commission at their <br /> August 16, 2005 meeting. <br /> Adopted this 23rd day of Au ust, 2005. <br /> • <br /> &"kAk&'2' <br /> .Mayor <br /> ATTEST: <br /> City Clerk <br /> Review for Administration: <br /> ity ger <br />
