CITY OF ST. ANTHONY <br /> RESOLUTION NO. 05-073 <br /> RESOLUTION RELATING TO ASSIGNMENT, ASSUMPTION, EASEMENT, <br /> PARK MANAGEMENT AND MAINTENANCE AGREEMENT <br /> WHEREAS, the City of St. Anthony(the"City") and the St. Anthony Housing and <br /> Redevelopment Authority(the "Authority") entered into a Redevelopment Agreement, dated <br /> December 19, 2003, regarding an area located in the northwest portion of the City(as amended, <br /> the "Redevelopment Agreement"); and <br /> WHERAS, under the terms of the Redevelopment Agreement, certain members of the <br /> development team are responsible for construction of Ponding Site Improvements (as defined in <br /> the Redevelopment Agreement); and <br /> WHEREAS, in exchange for public use of the Ponding Site Improvements and other <br /> developer-provided improvements, the City and the Authority wish to assume certain financial <br /> responsibility for ongoing maintenance; and <br /> WHEREAS, rules need to be established for public use of the facilities. <br /> ® WHEREAS, this shall be known as Salo Park. <br /> NOW, THEREFORE, BE IT RESOLVED, by the City of St. Anthony, Minnesota as <br /> follows: <br /> That the Mayor and City Manager are authorized to finalize and enter into a <br /> Assignment, Assumption, Easement, Park Management and Maintenance <br /> Agreement with the Housing and Redevelopment Authority of the City of Saint <br /> Anthony, Minnesota, and Apache Park, LLC. <br /> Adopted this 13`h day of September, 2005.
