• CITY OF ST. ANTHONY VILLAGE <br /> RESQLUTION 06-062 <br /> A RESOLUTION FOR A VARIANCE FOR PARKING EXPANSION <br /> AT 2825/2827 ANTHONY LANE SOUTH <br /> WHEREAS, the St.Anthony Planning Commission held a public hearing on July 18,2006, <br /> regarding a request for a variance for parking expansion located at 2825/2827 <br /> Anthony Lane South;and <br /> WHEREAS, The property cannot be put to a reasonable use without the variance. The <br /> Planning Commission determined that Mr. O'Brien would not be able to put his <br /> property to reasonable use if the variance request was denied. His business has <br /> grown over the years,requiring hien to add more employees. Denying the <br /> variance would cause him to restrict the operations of his business; and <br /> WHEREAS, The circumstances causing the hardship were not created by the owner. The <br /> building was originally built in 1981 as Hub Warehouse and Mr. O'Brien is a <br /> subsequent owner. The current 27 parking spaces met the number required for <br /> the warehouse square footage and the number of employees on the largest shift <br /> for the Hub Warehouse. Over time,Mr. O'Briens business has grown,requiring <br /> • him to add staff to accommodate the needs of his business. As a result,this has <br /> increased the number of parking spaces required by the Ordinance for the site <br /> based on the number of employees on the largest shift; and <br /> WHEREAS, The variance,if granted,will not alter the essential characteristics of the locality. <br /> The Industrial District is designated for and the regulation of the development of <br /> light industry. This designation is due to the proximity of high traffic capacity <br /> roadways and rail facilities to accommodate the transport of manufactured <br /> products. The Planning Commission found that approving the variance for <br /> additional parking spaces would not alter the essential character of <br /> the area; and <br /> WHEREAS, Economic considerations alone are not the basis of the hardship. While the <br /> variance, if approved,would provide for the construction of the minimum <br /> number of parking spaces required to satisfy the spirit and intent of the Zoning <br /> Code for this zoning district. Adding another 19 parking spaces as part of this <br /> variance could possibly be seen as economic in nature but the Planning <br /> Commission found that Mr. O'Brien's request is not based on economics alone. <br /> His request is based on the operational needs of his business and the requirement <br /> of the City's Ordinance requiring him to have parking spaces enough for the <br /> largest shift;and <br /> WHEREAS, The circumstances causing the Hardship are unique to the individual lot. The site <br /> • is a corner lot, adjacent to a busy county road and two interior streets. Each side <br /> adjacent to a street requires a larger set back than an interior lot.
