ANTHONY VILLAGE <br /> RESOLUTION 08-072 <br /> A RESOLUTION FOR AN ADMINISTRATIVE LOT COMBINATION <br /> FOR 3523 HARDING STREET NE <br /> WHEREAS, Staff discovered during the normal application review process of applications for <br /> demolition and building permits for 3523 Harding Street NE submitted by Mr.Patrick <br /> O'Keefe,Skyway Construction/Bayshore Properties that this property consisted of two <br /> non-conforming lots;and <br /> WHEREAS, Further research revealed that the existing residential structure was built on these non- <br /> conforming lots in 1957;and <br /> WHEREAS, Hennepin County also showed two lots for 3523 Harding Street NE on their plat map <br /> with two(2)different PIN numbers but the same legal description and; <br /> WHEREAS, Staff determined that there was probably an original intent to combine these lots but for <br /> some reason it was never done;and <br /> WHEREAS, These two(2)lots have existed as 3523 Harding Street since 1957 and were <br /> grandfathered in when the City codified its Land Use and Zoning ordinance in August <br /> 1976;and <br /> WHEREAS, When the original structure was demolished to build a replacement residential structure, <br /> a significant market value was removed,requiring the owner to bring the property into <br /> compliance with the City's zoning ordinance;and <br /> WHEREAS, The current owner,Skyway Construction/Bayshore Properties did not cause the <br /> situation and were unaware of the non-conforming status of the residential lots at 3523 <br /> Harding;and <br /> WHEREAS, The current owners of 3523 Harding Street NE agreed to the Administrative Lot <br /> Combination and signed the Declaration of Lot Combination agreement;and <br /> WHEREAS, A Public Hearing was held at the November 18,2008 Planning Commission meeting;and <br /> WHEREAS, No opposition was voiced and the Planning Commission members unanimously moved <br /> a recommendation to City Council approving the Administrative Lot Combination for <br /> 3523 Harding Street NE. <br /> NOW,THEREFORE BE IT RESOLVED,the St. Anthony City Council approves an <br /> Administrative Lot Combination for the lots located at 3523 Harding Street NE, thereby creating one <br /> conforming residential lot. <br /> • <br /> Z:\Council Meetings\2008\11252008\Res Lot Combo 3523 Harding St.doc <br />
