CITY OF ST. ANTHONY VILLAGE <br /> RESOLUTION 10-052 <br /> A RESOLUTION FOR APPROVAL OF A CONDITIONAL USE PERMIT FOR A <br /> RESTAURANT LOCATED AT 3701 STINSON BOULEVARD <br /> AND THAT IS WITHIN 250 FEET OF <br /> A RESIDENTIAL STRUCTURE OR DISTRICT <br /> WHEREAS, the St. Anthony Planning Commission held a public hearing on July 20, <br /> 2010 as required by the City of St. Anthony Zoning Code, Section 1655.04, <br /> Conditional Use Permits; and <br /> WHEREAS, the Planning Commission reviewed and considered that the requested <br /> conditional use is one of the Permitted Conditional Uses specifically listed <br /> at§152.122 (P), for the commercial zoning district in which the conditional <br /> use is located; and <br /> WHEREAS, the Planning Commission reviewed and considered that the requested <br /> conditional use permit will not be detrimental to health, safety, or general <br /> welfare of persons residing or working in the vicinity or injurious to <br /> property values or improvements in the area; and <br /> WHEREAS, the Planning Commission reviewed and considered that the requested <br /> conditional use permit is necessary or desirable at the subject location to <br /> provide a service or a facility which is in the interest of public convenience <br /> and will contribute to the general welfare of the neighborhood or <br /> community; and <br /> WHEREAS, the Planning Commission reviewed and considered the following to be <br /> conditions of a conditional use permit for 3701 Stinson Boulevard: <br /> 1. Garbage areas must be enclosed with materials that match <br /> the building; and <br /> 2. Lighting must be "down spill" with no spillage to affect the <br /> adjacent residential properties; <br /> 3. No music or other artificial noise shall be audible from the <br /> restaurant to adjacent residential properties; <br /> 4. The remodel and redevelopment of the property shall <br /> conform as closely as possible and practicable to The Village <br /> at St. Anthony design standards and PUD documents; and <br /> WHEREAS, the City Council has received and reviewed the Conditional Use Permit <br /> application as provided by Mr. Terry Abney, Abney Development <br /> Z:\Council Meetings\2010\07272010\RESCUP 250 feet from Res dist IHOP.doc <br />
