CITY OF ST. ANTHONY <br /> RESOLUTION 12-026 <br /> A RESOLUTION APPROVING THE PLANNED UNIT DEVELOPMENT <br /> AGREEMENT AND THE PLANNED UNIT DEVELOPMENT ORDINANCE RELATED <br /> TO THE CONSTRUCTION OF THE AUTUMN WOODS ASSISTED LIVING <br /> FACILITY IN SAINT ANTHONY VILLAGE, HENNEPIN COUNTY,MINNESOTA <br /> WHEREAS, on November 15, 2011, Autumn Woods III, LLC, a Minnesota limited liability <br /> company(the"Developer"), submitted a request to Saint Anthony Village, a <br /> Minnesota statutory city (the "Cily"), to construct the Autumn Woods Assisted <br /> Living Facility, a senior assisted living facility consisting of 72 assisted living <br /> units and up to four stories (the "Project") and more specifically described in the <br /> attached Exhibit A(the "Pro e "). <br /> WHEREAS, on November 15, 2011, at the City's Planning Commission Meeting, the City <br /> received from the Developer a Preliminary Development Plan for the Project. <br /> WHEREAS, the City's Planning Commission has received a Final Development Plan for the <br /> Project, dated October 13, 2011 and as updated on January 4, 2012. <br /> WHEREAS, the Property is currently included in a Planned Unit Development designation that <br /> exists as part of a Planned Unit Development approved in 2003 for the <br /> Developer's Autumn Woods I complex located adjacent to the Property. <br /> WHEREAS, to construct the Project on the Property and allow for its specific use as a senior <br /> assisted living facility as described above, the City must approve the Final <br /> Development Plan as an amendment to the currently existing Planned Unit <br /> Development. <br /> NOW, THEREFORE BE IT RESOLVED,that the City Council of Saint Anthony Village does <br /> hereby approve the following: <br /> 1. City Ordinance No. 2012-02, which amends the City Code to allow for the <br /> specific use of the Project on the Property; <br /> 2. PPp�l n;?�ed Unit Development Agreement (the "Development Agreement"), dated <br /> RYJV06Z , 2012, between the City and the Developer for <br /> construction o the Project; and <br /> 3. Agreement for Special Assessment Petition, Consent, and Waiver(the"Special <br /> Assessment Agreement"), dated YI(AQ Z�_2012, between the City and <br /> the Developer for the levying of special assessments regarding public sewer <br /> improvements,as described therein. <br />
