• Voting on the motion: <br /> Aye: Sundland, Haik, Stauffer and Sauer <br /> Nay: Miedtke <br /> Motion to table carried. <br /> Council members agreed to document in writing by July 5th all the con- <br /> ditions they wished to have included in the Concept Development Plan and <br /> these are to be distributed by Staff to each of them and a copy of each <br /> made available to the applicant prior to July 8th. <br /> The discussion of the P.U.D. was continued with Councilman Stauffer ex- <br /> pressing her opposition to specific designation of architectural style for <br /> the commercial buildings she wanted only "consistent architectural style" <br /> stipulated. The City Attorney said the City could not have architectural <br /> control at its complete discretion and that he felt the courts would rule <br /> only reasonable control could be exerted. <br /> Councilman Haik said she felt "any strip shopping center was unpalatable <br /> and not attractive to the City as a whole and would not be cohesive ad- <br /> dition to the community" . <br /> The Board representative then continued with the June 21st minutes giving <br /> the Board' s recommendations regarding the expansion of the- Berger Transfer <br /> • and Storage, Inc. , building along 37th Avenue N.E. <br /> William Dircks of Berger said his company would experience a hardship if <br /> they were not allowed to expand their building. The Berger manager said <br /> the proposed addition would require not only the 4 . 85 foot front yard <br /> variance but also the side yard variance which will permit the building to <br /> be constructed within 2 . 8 feet of the property line. Mr. Fornell 's <br /> memorandum of June 27th provided clarification of the size of the front <br /> yard setback variance required. <br /> Henry Murloswki of Belaire Buildings indicated on the site plans how the <br /> southwestern corner of the building could be built with a jog to prevent <br /> visual blockage of the Auto Trac building to the west. <br /> Motion by Councilman Stauffer and seconded by Councilman Haik to grant a <br /> sidy yard variance to the City Zoning Ordinance to Berger Transfer and <br /> Storage, Inc. , which will allow them to expand their existing building on <br /> 37th Avenue N.E. , within 2. 8 feet of the westerly property line because <br /> the topography of that parcel and other factors constituted conformance <br /> with the variance section of the Zoning Ordinance. <br /> Motion carried unanimously. <br /> Mr. Fornell confirmed that the addition will conform to the floor area <br /> requirements of the City Ordinance. <br /> (4) <br />
