City Council Regular Meeting Minutes
• January 23, 2001
Page 7
E. Harding Street Project Review property acquisition and update (Evergreen Land
Services).
4. Discuss condemnation process.
Matt Storm, Evergreen Land Services, stated there are a number of properties remaining
to obtain easements which will take some time so he would recommend the City proceed
with the condemnation process so the 90-day clock begins. He noted that during that
time period, negotiations with residents can continue.
City Attorney Jerome Gilligan advised how the condemnation timing and quick take
process occurs. He noted that once the Harding Street pond project is awarded, the City
is committed to do the project and easements are needed for the City to complete the
project. He recommended the contract be awarded and the quick take process started.
Mr. Storm stated ten easements are needed. Three residents have retained the same
attorney and will be getting their own appraisals done, which will probably take until
March. He advised that negotiations with those three property owners has, basically,
astalled.
Sparks noted the Council is being asked to vote on the properties that have accepted the
offer.
Mr. Hubmer reviewed the timeline for this project with construction starting the
beginning of May. He noted that the condemnation proceedings may go into the second
week of May, which means the contract would be delayed by several weeks. Mr.
Hubmer explained that the contractor may be willing to push the schedule back several
weeks, but timing needs to stay on schedule.
Sparks asked about the maintenance agreement and if that issue has come up during
negotiations. Mr. Hubmer stated that is part of the process, noting the contingencies
added to the agreements signed to-date.
Mr. Storm reviewed the issues that were part of the negotiations including the relocation
of a watering line and tree. Other issues were raised about the pond and if it will have
sand.
Sparks stated she knows one resident has asked for a maintenance agreement on the pond.
Mr. Hubmer advised that another resident meeting will be held on February 6, 2001, to
review the landscaping and maintenance issues. He stated that the City will have to
maintain this pond to remove sedimentation and debris.
1. Resolution 01-032 re: Drainage easement for 2800-3155 Avenue NE.
