City Council Regular Meeting Minutes <br /> • January 8, 2002 <br /> Page 7 <br /> 1 Tanner stated that he did not feel that the words"good faith"were appropriate <br /> 2 where Essenco was concerned, highlighting the fact that they were up and <br /> 3 running before they had a permit at all. <br /> 4 <br /> 5 Steve Levitus, owner of Essenco, came forward and stated that the early start-up <br /> 6 was a genuine misunderstanding on their behalf. He added that they have not <br /> 7 been operating for several weeks, and stated that he was completely committed to <br /> 8 working with the community. <br /> 9 <br /> 10 Mayor Hodson asked City staff if there was enough information for them to draft <br /> 11 an ordinance at this time, in order to give Essenco the ability to begin operations <br /> 12 again. <br /> 13 <br /> 14 Gilligan stated that it was difficult to do. He suggested that they set a time limit, <br /> 15 after which they could pull the conditional use if requirements of the permit were <br /> 16 not met. <br /> 17 <br /> 18 After much discussion, the Council decided to draft a revised version of the <br /> 19 conditional use permit that the Planning Commission recommended. They <br /> decided that they would grant the permit based on a trial period that expires on <br /> 0 September 1, 2002. <br /> 23 Councilmember Sparks was in disagreement with the length of time, feeling that <br /> 24 it was far too long. <br /> 25 <br /> 26 Solie stated that they could not appropriately respond to the requirements of a <br /> 27 conditional use permit based on a 6-month trial period. He added that, if that <br /> 28 were the case,they would simply revoke their request tonight. <br /> 29 <br /> 30 Resident Jennifer Tanner stated that her greatest concern was over what was <br /> 31 being done in"good faith" at this time to remedy the identified odor problem. <br /> 32 <br /> 33 Mayor Hodson clarified that the Council would only grant the permit through <br /> 34 September 1, 2002. <br /> 35 <br /> 36 Solie and Levitus indicated that the September 1, 2002 deadline was simply not <br /> 37 long enough for them. Gilligan suggested that the Council went forth with a <br /> 38 motion,and that Essenco determine what they will do once the motion has been <br /> 39 made. <br /> 40 <br /> 41 Motion by Councilmember Faust to grant the conditional use permit for Village <br /> 42 North, LLP, 280137" Avenue Northeast with the following conditions: <br /> 40 • Candle manufacturing can only occur between the hours of 6:00 a.m. <br /> 4-t through 4:00 p.m., Monday through Saturday. <br />
