12.1.7 Expense of any additional insurance coverage or limits, including <br /> professional liability insurance, requested by the City in excess of that required under <br /> this Agreement. <br /> 12.1.8 If their employment is authorized in writing in advance by the City as an <br /> amendment to this Agreement, the professional fees and other related expenses of <br /> special consultants retained by the Architect to assist with the Project. <br /> 12.1.9 The Architect will be reimbursed by the City for any plan checking fees or <br /> building permit fees required to be paid to governmental agencies by the Architect. <br /> 12.1.10 Expenses reasonably incurred in connection with the Architect's provision <br /> of Additional Services pursuant to this Agreement. <br /> 12.1.11 The current rates for the foregoing Reimbursable Expenses are set forth on <br /> Exhibit "F" attached hereto. Architect shall obtain the City's prior written approval <br /> of estimated Reimbursable Expenses. <br /> ARTICLE 13. MISCELLANEOUS PROVISIONS. <br /> 13.1 This Agreement shall be governed by the law of the State of Minnesota. <br /> 13.2 Terms used in this Agreement, unless otherwise defined herein, or unless <br /> inconsistent or in conflict with the provisions of this Agreement, shall have the <br /> same meanings ascribed to such terms in the Contract Documents. <br /> 13.3 The City and the Architect waive all rights against each other and against the <br /> Contractors, consultants, agents, and employees of the other for damages recovered <br /> from any insurance during construction as set forth in the Contract Documents. <br /> The City and the Architect each shall require appropriate similar waivers from their <br /> Contractors, consultants, and agents. <br /> 13.4 Each of the Exhibits attached to this Agreement is hereby incorporated by <br /> reference and made a part of this instrument as if fully set forth herein. <br /> 13.5 The remedies provided to the City pursuant to the terms of this Agreement are <br /> cumulative and not exclusive of any other remedies available at law, in equity or <br /> otherwise. <br /> 13.6 The Architect and the City agrees that all contracts and agreements which <br /> either enters into with subcontractors, agents and employees furnishing services or <br /> materials in connection with the Project or the services to be performed by the <br /> -16- <br />
