B. The Subrecipient will furnish all information and reports required to comply with <br /> the provisions of 24 CFR Part 570 and all applicable state and federal laws, rules, <br /> and regulations pertaining to discrimination and equal opportunity. <br /> 19. NON-DISCRIMINATION BASED ON DISABILITY <br /> A. The Subrecipient shall comply with Section 504 of the Rehabilitation Act of 1973, <br /> as amended, to ensure that no otherwise qualified individual with a handicap, as <br /> defined in Section 504, shall, solely by reason of his or her handicap, be excluded <br /> from participation in, be denied the benefits of, or be subjected to discrimination <br /> by the Subrecipient receiving assistance from the Recipient under Section 106 <br /> and/or Section 108 of the Housing and Community Development Act of 1974, as <br /> amended. <br /> B. When and where applicable, the Subrecipient shall comply with, and make best <br /> efforts to have its third party providers comply with, Public Law 101-336 <br /> Americans With Disabilities Act of 1990, Title I "Employment," Title II "Public <br /> Services" - Subtitle A, and Title III "Public Accommodations and Services <br /> Operated By Private Entities" and all ensuing federal regulations implementing said <br /> Act. <br /> 20. LEAD-BASED PAINT <br /> The Subrecipient shall comply with the Lead-Based Paint notification, inspection, testing <br /> and abatement procedures established in 24 CFR 570.608. <br /> 21 . FAIR HOUSING <br /> The Subrecipient shall be prohibited from receiving CDBG funds for activity/ies subject <br /> to this Agreement should it not affirmatively further fair housing within its own <br /> jurisdiction or impede action taken by Recipient to comply with the fair housing <br /> certification. <br /> 22. LOBBYING <br /> A. No federal appropriated funds have been paid or will be paid, by or on behalf of <br /> the Subrecipient, to any person for influencing or attempting to influence an <br /> officer or employee of any agency, a Member of Congress, an officer or employee <br /> of Congress, or an employee of a Member of Congress in connection with the <br /> awarding of any Federal contract, the making of any Federal Grant, the making of <br /> any Federal loan, the entering into of any cooperative agreement, and the <br /> extension, continuation, renewal, amendment, or modification of any Federal <br /> contract, grant, loan, or cooperative agreement. <br /> B. If any funds other than Federal appropriated funds have been paid or will be paid <br /> to any person for influencing or attempting to influence an officer or employee of <br /> any agency, a Member of Congress, an officer or employee of Congress, or an <br /> employee of a Member of Congress in connection with this Federal contract, <br /> 8 <br />
