If the <br /> test result of the primary specimen is positive, the driver may request that <br /> the MRO direct the split specimen be tested in any different DHHS - <br /> certified laboratory for presence of the drug(s). <br /> 382.107 Consortium - an entity, including a group or association of employers or <br /> contractors, that provides alcohol or controlled substance testing as required <br /> by federal regulations, or other U.S. Department of Transportation alcohol <br /> or controlled substances testing rules, and that acts on the behalf of the <br /> employers. <br /> Controlled Substance - as defined by 21 U.S.C. 802 and includes all <br /> substances listed on Schedule 1-5 as they may be revised from time to time <br /> (21 C.F.R., Part 1308). <br /> Subpart DHHS - The Department of Health and Humans Services or any designee of <br /> 40.3 the Secretary of the Department of Health and Human Services. <br />
