r <br /> (8) PERMITTED USE: The Premises shall ma -v be used by the Tenant &"Iy for the <br /> • purpose of conducting and operating the business of an off-sale liquor store and such other similar or related <br /> uses which are or may become customarily conducted in conjunction with an off-sale liquor store. In addition, <br /> permitted assignees or subtenants of Tenant under Article 16 hereof may use the Premises for other lawful <br /> purposes which otherwise comply with all Private Restrictions, as hereinafter defined. <br /> (9) TENANTS BUSINESS NAME: Teflant Shall operate and do Tenant's business in the <br /> Premises, and all signs and advertising shall bey under the trade name St.Anthonv Villnee <br /> Liquor Warehouse or such other new name as Tenant may select, provided such new name is not the same <br /> as,or confusingly similar to,any other tenant in the Shopping Center. During the Term of this Lease,Tenant <br /> may include the name of the Shopping Center in its business letterheads and in all other advertising,but shall <br /> not use such name for any other purpose. <br /> (10) ANNUAL MINIMUM RENT: <br /> a) For the period commencing on the Commencement Date and ending 60 months thereafter <br /> (provided that if the Commencement Date is a day other than the first day of a calendar month,then the said <br /> period shall end 60 months after the last day of the calendar month in which the Commencement Date occurs <br /> it being the intention of the parties hereto that the last day of such period,and any applicable option period, <br /> shall be the last day of a calendar month), Annual Minimum Rent shall be $53,162.50 annually, payable <br /> $4,430.21 monthly, based upon a rental rate of$6.25 per square foot. <br /> b) For the period of 60 months following the period described in (a) above,Annual Minimum Rent <br /> shall be $57,415.50 annually, payable $4,784.63 monthly, based upon a rental rate of$6.75 per square foot. <br /> C) For the period of 60 months following the period described in (b) above, Annual Minimum <br /> Rent shall be $61,668.50 annually, payable $5,139.04 monthly, based upon a rental rate of$7.25 per square <br /> foot. <br /> d) Subject to Article 3 hereof, for the period (the Option Term) of 60 months following the <br /> period described in (c) above,Annual Minimum Rent shall be the then"current market rent" (determined in <br /> accordance with Article 3) for similar commercial property in the Minneapolis/St. Paul metropolitan area; <br /> provided, however,such Annual Minimum Rent shall not be less than the Annual Minimum Rent described <br /> in (c) above. <br /> Annual Minimum Rent is subject to possible adjustment in accordance with Article 6, Section D <br /> hereof. <br /> (11) PERCENTAGE RENT: Not applicable. <br /> (12) SECURITY DEPOSIT: None. <br /> (13) GUARANTORS: None. <br /> Each reference in this Lease to any of the data contained in this Data Sheet shall be construed to incorporate <br /> the data stated under this title. <br /> 326559.8 Redlined V8 to V7 9.27-96 2 <br />
