Agreement No. PW 07-10-97 <br /> CSAH 27; C.P. 9705 <br /> XII <br /> The City also agrees that any contract let by the City or its agents for <br /> the performance of the work on CSAH 27 as provided herein shall include clauses <br /> that will : (1) Require the Contractor to defend, indemnify, and save harmless <br /> the County, its elected officials, officers, agents, volunteers and employees <br /> from any liability, claims, causes of action, losses, demands, damages, <br /> judgments, costs, interest, expenses (including, without limitation, reasonable <br /> attorney's fees, witness fees, and disbursements incurred in the defense <br /> thereof) arising out of or by reason of the negligence of the said Contractor, <br /> its subcontractors, anyone directly or indirectly employed by them, and/or <br /> anyone for whose acts and/or omissions they may be liable for. (2) Require the <br /> Contractor to be an independent contractor for the purposes of completing the <br /> work provided for in this Agreement. (3) Require the Contractor to provide and <br /> maintain insurance in accordance with the following: <br /> 1 . Workers' Compensation including Employers' Liability Insurance: <br /> - Bodily Injury by Accident $100,000 each accident <br /> - Bodily Injury by Disease $500,000 policy limit/ <br /> $100,000 each employee <br /> Note: An all states endorsement is required if the Contractor is <br /> based outside the State of Minnesota. <br /> 2. Commercial General and Automobile Liability Insurance: <br /> (A) Commercial General Liability: <br /> - Combined Bodily Injury and Property Damage: <br /> - Each Occurrence Limit $1,000,000 <br /> - General Aggregate Limit $1 ,000,000 <br /> - Products--Completed Operations <br /> Aggregate Limit $1 ,000,000 <br /> - Personal and Advertising Injury <br /> Limit $1 ,000,000 <br /> - Coverages above shall also include: <br /> - Premises--Operations <br /> - Contractual Liability (including oral and written <br /> 5 - ��� <br />
