r <br /> • (b) No Contractor, material supplier, or vendor shall, in any manner, <br /> discriminate against, or intimidate, or prevent the employment of any such person <br /> or persons, or conspire to prevent, any such person or persons from the <br /> performance of work under any contract on account of race, color, religion, national <br /> origin, place of residence, political affiliation, disability, marital status with regard to <br /> public assistance, sex or age. <br /> (c) This Contract may be terminated by the City, and all money due, or to become <br /> due may be forfeited for a second or any subsequent violation of the terms or <br /> conditions of this section. <br /> 5. ASSIGNMENT OF CONTRACT <br /> No assignment by Contractor of this Contract or any part thereof or of the funds to <br /> be received thereunder, will be recognized unless such assignment has had the <br /> written approval of the City. <br /> 6. SUBCONTRACTS <br /> Contractor shall not subcontract the Work. <br /> 7. INSURANCE <br /> • Contractor shall not commence Work until all insurance required has been <br /> approved by the City. Evidence of the following insurance shall be furnished: <br /> A. Worker's Compensation Insurance.. Statutory worker's compensation insurance <br /> and employer's liability insurance as required under the laws of the State of <br /> Minnesota. <br /> B. General Liability Insurance <br /> (1) Public Liability Insurance. Public liability and property damage insurance in the <br /> amount of $200,000 for injuries or death to any one person, $500,000 for injuries or <br /> death resulting from one accident, and $100,000 for property damage. <br /> (2) Automobile Insurance. Automobile insurance on all automotive equipment <br /> owned, rented or borrowed in the same minimum amounts set forth above. <br /> (3) Contractual Liability Insurance. Contractor agrees to hold harmless and <br /> indemnify the City and all councilmembers, officers, agents, employees, and <br /> insurers thereof, and the City Representative, and their agents, from every claim, <br /> action, cause of action, liability, damage, expense or payment incurred by reason of <br /> any bodily injury, death, or property damage resulting from Contractor's operations, <br /> • <br /> -2- <br />
