STATE OF MINNESOTA <br /> Division of Emergency Management (DEM) <br /> Hazard Mitigation Grant Program (HMGP) <br /> ENVIRONMENTAL ASSESSMENT REQUIREMENTS <br /> The National Environmental Policy Act (NEPA) of 1969, P.L. 91-190, as amended requires that <br /> environmental information be available to public officials and citizens before decisions are made <br /> and actions are taken. This information is consolidated and analyzed in environmental <br /> documents, either Environmental Assessments or Environmental Impact Statements. It is <br /> FEMA's responsibility to prepare the environmental document, although the project applicant will <br /> be required to provide much of the basic information, including any special studies that need to <br /> be performed. <br /> Authority. Projects funded under the Hazard Mitigation Grant Program (HMGP) must comply <br /> with all appropriate environmental requirements. This includes compliance with the National <br /> Environmental Policy Act (NEPA) of 1969, P.L. 91-190, as amended; Executive Order 11988, <br /> Floodplain Management; and Executive Order 11990, Protection of Wetlands. Detailed guidance <br /> for implementing NEPA can be found in FEMA regulations at 44 CFR Part 10 and FEMA <br /> Environmental Review Handbook, DR&R-6. 44 CFR Part 9 addresses compliance with Executive <br /> Orders 11988 and 11990. The Floodplain Management Handbook, DR&R-11, contains <br /> additional guidance on the executive orders. Other environmental legislation that may be <br /> licable in this process includes: Section 7 of the Endangered Species Act of 1973, Section <br /> 6 of the Historic Preservation Act of 1966, Section 40 (b) (1 ) of the Clean Water Act of <br /> 1977, and Section 10 of the Rivers and Harbors Act of 1899. <br /> Further information regarding the specific Environmental Assessment Requirements that must be <br /> met for a particular (potential) HMGP project will be forwarded by DEl1i to the applicant as <br /> appropriate. <br /> DPS-DEM <br /> A V3 <br />
