Public Hearing closed at 8:10 <br /> P.M. <br /> Dlotion by Mr. Letourneau, seconded by Mr. Marks to recommend a denial of the request <br /> for a 5 foot side yard variance by Mrs. Dale Michaelhoff to build a 68 ft. house on <br /> the 78 ft. lot at 360+ Downers Drive because the proposal does not comply with the <br /> zoning ordinance as to size and the City had refused other similar requests in the past. <br /> Voting on the motion <br /> Aye: Marks. Johnson; Letourneau, McGinn and Bowerman <br /> Nay: Kronk and Hiebel <br /> Motion carried. <br /> Mr. Johnson said he would be unable to represent the Board at the Council meeting <br /> October 22nd and T,Ir. Letourneau agreed to take his place. The Chairman then extended <br /> the invitation from the Mayor to the entire Board to attend the Council Meeting at <br /> 9:00 P.M. <br /> e Public Hearing on the Bernu Construction Company request for a sign variance was <br /> not held since no one appeared. to present .the request. Mr. Fornell said that <br /> although a representative of Bernu Construction Company had been at the Council <br /> meeting when the public hearing was ordered and had been in touch with Mr. Lekson <br /> in the interim, there was some doubt whether an official notice had been sent to the <br /> Bernu Company and that filing fee for making an application had not been paid. Mr. <br /> Hiebel and Mr. Johnson felt the Board did not have adequate specifications of the <br /> sign. Mr. Kronk was concerned with the expense of holding another public hearing. <br /> Mdtion by Mr. Johnson, seconded by Mr. Letourneau to table action on the request for <br /> a sign variance for the Midwest Professional Bldg. until the applicant properly notified <br /> and the proper administrative procedures are followed. <br /> Motion carried. <br /> Mr. Fornell told the Boaxd that the proprietor of the Village Inn Cafe did not want to <br /> pay the filing fee for application for a sign variance as long as it was not reimburs- <br /> ible if he did not receive a sign variance. He had stated his intentions of consulting <br /> his attorney on the legality of the fee. The variance would alloy a sign identifying <br /> his cafe to be placed on the roof of the Union 76 station which is on the Kenzie `I_rr. <br /> side of the same building. <br /> The Planning Board was unable to act on the matter because it had no application and <br /> following a discussion of the relationship of the amounts charged for applications for <br /> variances in R-1 and R-2 districts and from the sign ordinance, the following motion <br /> was made. <br /> Motion by Mr. Bowerman, seconded by Dir. Johnson to recommend to the Council that the <br /> relationship between fee schedules for variances be examined so there can be reasonable <br /> Equity among them. <br /> Motion carried. <br /> Mrs. McGinn told of plans being made for a joint Council/Planning Board dinner meeting <br /> in December. <br /> Motion by Mr. Masks, seconded by Dir.
