Planning Commission Meeting Minutes <br /> July 15, 2003 <br /> Page 5 <br /> 10 and Highway 88, and the other new building would be situated where the existing strip center is <br /> 2 currently located. She stated that both properties, 2900 Kenzie Terrace and 2700 Highway 88, <br /> 3 are zoned commercial. She stated that Amcon is requesting two conditional use permits, the first <br /> 4 for the restaurant as restaurants located less than 250 feet from a residential structure is a <br /> 5 permitted conditional use in a commercial district. She explained that the condition items to <br /> 6 consider here might be noise, traffic, trash removal, lighting and hours of operation. She further <br /> 7 explained that it is unknown at this time if the restaurant, Spectators, is interested in having <br /> 8 music piped out to the outdoor patio. She stated that the second conditional use permit is for the <br /> 9 on-sale liquor store, which is also a permitted conditional use in a commercial zoning district. <br /> 10 <br /> 11 Ms. Hall stated that the applicant is requesting two front yard setback variances. She stated that <br /> 12 the variance request consists of two front yard setback variances of 30 feet each for a proposed <br /> 13 setback of 5 feet at the building corners. The applicant has stated that due to the triangular shape <br /> 14 of the parcel the tendency is to develop the site similar to its current layout with the building to <br /> 15 the south side and the parking out to the corner. According to the developer, one of the strengths <br /> 16 to the design is to reduce the impact of the parking lot and to reinforce the street edge by using <br /> 17 the restaurant to wrap around and create a corner. This keeps the parking central within the sit to <br /> 18 allow shared use of the parking. In addition, Ms. Hall stated that one rear yard setback variance <br /> 19 of 10 feet is being requested for the proposed setback of 10 feet at the southeast corner property <br /> 20 line jog. <br /> 21 <br /> Ms. Hall stated that the final variance request is related to parking. She stated that the developer <br /> is requesting a parking variance of 40 stalls for a proposed 40 parking stalls for a sit down <br /> 24 restaurant. She reviewed city code parking requirements with the Commission noting that to be <br /> 25 compliant with city code requirements they would need 80 parking stalls. She stated that the <br /> 26 developer is proposing 40 stalls for the restaurant with the balance to be shared with the retail <br /> 27 building. She stated that the developer shows 67 parking stalls for the retail area, which meets <br /> 28 city code. The developer has noted that due to staggered peak business times for retail and liquor <br /> 29 stores and the restaurant, the centralized parking would maximize the efficiency of the <br /> 30 development. Ms. Hall noted that the owner of the St. Anthony Shopping Center has expressed <br /> 31 concerns to staff stating that he does not want to be the spillover parking spot. <br /> 32 <br /> 33 Ms. Hall referenced the signage stating that the developer has told staff that they would keep <br /> 34 within the limits of the City sign ordinance and that all signage would be building/wall signage. <br /> 35 She reviewed signage with the Commission stating that it would consist of backlit logo signs and <br /> 36 that, according to the developer there would not be a glow to affect the residential area. She <br /> 37 stated that the City would be reconstructing the sidewalk this fall for a storm water project along <br /> 38 Kenzie Terrace noting that Amcon intends to connect the sidewalk to the buildings. She stated <br /> 39 that the City Engineer has been involved with the grading plans, adding that impervious surface <br /> 40 around the site has been reduced and that drainage would be improved. <br /> 41 <br /> 42 Commissioner Hanson asked if the Stonehouse is currently a conditional use permit. Ms. Hall <br /> 43 confirmed that it is. Commissioner Stromgren and Tillman asked for further clarification of the <br /> 250-foot line. Ms. Hall reviewed the lot line and conditional use permit issues with the <br /> Al Commission. <br /> 46 <br />
