h <br /> Planning Commission Meeting Minutes <br /> March 15,2005 <br /> Page 6 <br /> 1 the house is currently located in the north corner of the lot. <br /> 2 <br /> 3 Commissioner Jensen noted that the Hennepin County Map is not adding up to the total area of <br /> 4 land in discussion. He stated that it appears, from an area point of view, that they do have more <br /> 5 than enough space. He suggested confirming all of the areas on the map noting that they would <br /> 6 have to do a formal survey. Ms. Moore-Sykes agreed adding that they currently do not have a <br /> 7 survey on file. <br /> 8 <br /> 9 Commissioner Jensen noted that on the map there is a house that is located on one of the interior <br /> 10 pieces with no access to roadways and asked if this is accurate. Mr. Walek confinned that there <br /> 11 is only one house on the lot and is located on the street side. <br /> 12 <br /> 13 Commissioner Jensen stated that the house is far enough north adding that it would depend on <br /> 14 how the code deals with restrictions. He clarified that the house must be at least 30 to 35-feet <br /> 15 from the street adding that there is a possibility that the second structure could exist deeper on the <br /> 16 lot. Ms. Moore-Sykes confirmed that they would have to be 30-feet back and the look of the <br /> 17 house should be basically in line with the other homes down the street. <br /> 18 <br /> 19 Commissioner Galyon asked if they are considering it as potential rental income or as a `for sale' <br /> 20 property. Mr. Walek explained that he plans to build the new home,move into the new home <br /> 21 and tear down the current home, rebuild and sell the second home upon completion. <br /> 22 <br /> 23 9.3 Lot South of Tires Plus—Proposed Drive-Through for Restaurant <br /> 24 <br /> 25 Ms. Moore-Sykes stated that she recently received a call from a realtor who has a client <br /> 26 interested in locating a Dairy Queen Restaurant on the lot south of the new Tires Plus. She <br /> 27 explained that they are interested in having a drive-through window for customer convenience <br /> 28 adding that she has advised the realtor about the City's restrictions on drive-through facilities. <br /> 29 She stated that the realtor has indicated a willingness to discuss the project with the Planning <br /> 30 Commission. She noted that she has not received any further inquiries and the realtor is not <br /> 31 present this evening to discuss this request. <br /> 32 <br /> 33 Vice Chair Hanson stated that there are several Dairy Queens located throughout the area and <br /> 34 questioned whether a Dairy Queen at this location would comply with Dairy Queen's <br /> 35 requirements for franchise locations. <br /> 36 <br /> 37 X.
