CITY OF ST. ANTHONY <br /> ORDINANCE 2005- <br /> AN ORDINANCE RELATING TO CONDITIONAL USE PERMITS AMENDING SECTION <br /> 1665.04 OF THE ST. ANTHONY CITY CODE <br /> The City Council of the City of St. Anthony hereby ordains: <br /> Section 1. <br /> Section 1665.04 of the St. Anthony City Code shall be amended, by modifying subdivision 3, to <br /> read as follows: <br /> 1665.04 Conditional Use Permits. <br /> Subd. 1. Procedure. An application for a conditional use permit is to be made on forms <br /> available from the Zoning Officer and must be signed by the owner of the property in <br /> question. The application must be accompanied by a fee in the amount set forth in <br /> Subsection 615.07. The applicant may be required to provide concept and final site <br /> plans, if requested by the Zoning Officer. <br /> Subd. 2. Public Hearing. The public hearing will be held by the Planning Commission. <br /> Notice of the hearing will be given in accordance with Section 115. The Planning <br /> Commission will then make a recommendation to the Council on the proposed changes. <br /> Subd. 3. Council Action. A conditional use permit may be granted only by a maiority <br /> �s vote of all members of the Council after determining that: <br /> (a) The use is one of the conditional uses specifically listed for the district in <br /> which the property is located. <br /> (b) The Council has specified all conditions which the Council deems <br /> necessary to make the use compatible with other uses in the area. <br /> (c) The use will not be detrimental to the health, safety, or general welfare of <br /> persons residing or working in the vicinity or to the values of property in <br /> the vicinity. <br /> (d) The use will provide a service or a facility which is in the interest of <br /> public convenience and will contribute to the general welfare. <br /> Subd. 4. Expiration. A conditional use permit authorizing the erection or alteration of a building <br /> will expire if construction has not commenced within 12 months after the conditional use permit <br /> is approved by the Council. <br />
