STAFF REPORT <br /> To: Planning Commission Report No.: VIII.1 <br /> From: Kim Moore-Sykes, Assistant City Manager 01 0S <br /> Date: July 19,2005 <br /> Subject: Concept Review of Code Text Change and Conditional Use Permit Request- <br /> 2829 Anthony Lane South <br /> Date Application Received: No Application submitted to date. <br /> Property Address: 2829 Anthony Lane South <br /> Zoning District: LI <br /> 60-Day Expires: N/A <br /> Requested Action: <br /> Eric Reiners,architect with Welman Sperides Architects, representatives for The IUO Local 49,has <br /> requested a concept review of their proposal for a text change to the City's Zoning Code that would include <br /> catering activities as a permitted conditional use in the Industrial Zoning District. The IUO Local 49 <br /> recently opened their newly constructed catering kitchen and related facilities and is also proposing to open <br /> them to the public. Originally,staff understood that this new facility was to be used for private, in-house <br /> use. <br /> In reviewing the City's Zoning Ordinance, there is no allowance given for this use either as a permitted use <br /> or a permitted conditional use. The Commercial zoning district does allow this use as a permitted <br /> conditional use. See Section 1635.03 (c) and (p). <br /> Concerns regarding traffic and parking associated with this proposal created a need to discuss them at a <br /> concept review. Because the uses allowed in this district already create high volumes of traffic, <br /> accommodate parking needs and suppose increased noise levels,including catering activities as a permitted <br /> conditional use for the Industrial Zoning District would not significantly increase parking, traffic or noise. <br /> By allowing catering activities as a permitted conditional use will give the City the ability to place controls <br /> on this use to protect the community and the public using these proposed catering facilities. <br /> Attachments: <br /> • Applicant's Letter <br /> • Letter from Hennepin County Human Services <br /> • Building Plans showing Catering Kitchen and related facilities <br /> H.\Planning\Staff Reports\2005\071905 concept IU049text chg conditional use doc <br />
