COMMUNICATION WITH CITY COUNCIL <br /> 17 6.1 Designate a Planning Commission member to the June 28, 2005 City Council Meeting. <br /> 18 <br /> 19 Chair Stromgren stated that the Commission would discuss designating a Planning Commission <br /> 20 representative for the next City Council Meeting on June 28, 2005, after the meeting. <br /> 21 <br /> 22 VII. PUBLIC HEARING. <br /> 23 <br /> 24 7.1 2513 West Armour Terrace NE—Petition of Variance, Rear Yard <br /> 25 <br /> 26 Chair Stromgren opened the public hearing at 7:07 p.m. <br /> 27 <br /> 28 Ms Moore-Sykes stated that this is a request by Mr. John Kaczmarczyk for a variance to the rear <br /> 29 yard requirements of the City Ordinance to construction a 26-foot by 30-foot garage in the rear <br /> 30 yard setback of his property. She stated that the property is located at 2513 West Armour Terrace <br /> 31 and is currently designated as R-1 zoning. She reviewed the property layout stating that this <br /> 32 residential interior lot is approximately 10,106 square feet and is 20-percent covered with <br /> 33 impervious surfaces and the proposed garage would increase the lot coverage to 28-percent. She <br /> 34 explained that because the proposed garage is too large it would not be eligible for a garage <br /> 35 setback permit as allowed by Section 1650.02, Subd. 6. She further explained that the applicant <br /> 36 is looking to build a garage approximately 780-square feet in size and the City Ordinance <br /> 37 requires that the garage would not cover an area larger than 528 square feet and have no <br /> 38 dimension greater than 24-feet within either a side yard or rear yard setback. She noted that the <br /> 39 applicant has been advised that the garage setback permit is for a smaller garage and it was noted <br /> 40 that the applicant would prefer the larger size. She stated they discussed moving the proposed <br /> 41 garage forward 10-feet to comply with the 25-foot rear yard setback and Mr. Kaczmarczyk <br /> 42 reported that moving it forward would bring the proposed garage to within 5-feet of his existing <br /> 43 back porch, which would be in violation of the State Fire Code, which requires a 6-foot clearance <br /> 44 between structures. She stated that Mr. Kaczmarczyk also reported that having 15-feet between <br />
