STAFF REPORT <br /> To: Planning Commission Report No.: NA <br /> From: Kim Moore-Sykes, Assistant City Manager <br /> Date: August 16, 2005 <br /> Subject: Zoning Ordinance Revision Discussion-Vehicle Sales <br /> Background: <br /> Staff has received several complaints recently from residents about all the vehicles for sale at Wiltshire Park <br /> School parking lot. Because this use is not listed as allowable in the Zoning Ordinance, selling vehicles in <br /> this manner is not allowed and would be towed away at the owner's expense and cited if these vehicles <br /> were parked on public property or public right-of-way. Wiltshire Park is considered private property and <br /> as such, the police can only respond if and when there is a call from the school staff. <br /> The Police and the Public Works Departments have been working with the School staff to determine a <br /> resolution to this situation. As a result of Staff discussion,I received a copy of the City of Falcon Heights' <br /> ordinance regarding vehicle sales. This ordinance language was used as an example of a possible ordinance <br /> that the City may adopt to alleviate the situation. This proposed language will be sent to the City Attorney <br /> and the Police Department for their comments. <br /> Proposed Text: <br /> Section 926-Restrictions on Vehicle Sales <br /> 926.01 Residential Districts. <br /> Subd 1 Motor vehicles and recreational vehicles which are permitted within the respective <br /> residential district may be advertised for sale and sold provided the vehicle is owned by the <br /> resident where the vehicle is parked and the3 vehicle is currently licensed and operable. <br /> Vehicles that are displayed for sale shall not be parked or stored on public property or the <br /> public rights-of-way within the City of St. Anthony. <br /> Subd 2 Commercial vehicles shall not be parked in a residential district and advertised for <br /> sale. <br /> 926.02 Non-Residential Districts. <br /> Subd 1 Motor,commercial and recreational vehicles shall not be displayed "for sale' or <br /> sold within non-residential districts unless the vehicle is owned by the employee of said <br /> business where the vehicle is parked and with the consent of the business owner. <br /> Attachments: <br /> • Copy of Vehicle Sales Ordinance from the City of Falcon Heights <br /> H.\Plammng\Staff Reports\2005\081605 Discussion on proposed Vehicle Sales ord.doc <br />
